THE VITAL STATISTICS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Vital Statistics Act is amended by this Act.

2(1)

Subsection 3(9.1) is replaced with the following:

Name of child

3(9.1)

Subject to subsection (9.4), the name of a child shown on the registration of the child's birth must consist of

(a) at least one given name; and

(b) a surname, which must not consist of more than four names.

Subsection 3(9.2) is amended, in the part before clause (a), by adding "subject to subsection (9.4)," before "the surname".

The following is added after subsection 3(9.3):

Single name

3(9.4)

A child may be given a single name that is determined in accordance with the child's traditional culture if

(a) the person or persons registering the child's birth provide the director with the prescribed evidence, if any; and

(b) the director approves the single name.

Who chooses single name

3(9.5)

The single name shall be the single name chosen by

(a) the child's parents if they are shown on the child's registration of birth and each of them agree on the name; or

(b) the person who completes the statement under subsection (2) if only one person certifies the child's birth.

Section 48 is amended by adding the following after clause (g):

(g.1) prescribing the evidence to be provided in respect of giving a child a single name;

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Vital Statistics Act.

The requirement that a person's name must consist only of the letters "a" to "z" and accents from the English or French languages is repealed.

The limit of four names in a surname is continued.

A person may be given a single name that is determined in accordance with their traditional culture.
