THE APPRENTICESHIP AND CERTIFICATION AMENDMENT ACT (APPRENTICESHIP SUPERVISION)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Apprenticeship and Certification Act is amended by this Act.

The following is added after section 18:

Ratio of 1:1 between apprentices and journeypersons

18.1(1)

For the purpose of providing supervision of apprentices, an employer must not permit the ratio of apprentices to journeypersons employed by the employer in a designated trade to exceed 1 to 1.

Ratios previously set by regulation may continue

18.1(2)

Despite subsection (1), if a higher ratio of apprentices to journeypersons is prescribed in a designated trade regulation before the coming into force of this section, that ratio may continue but must not be increased.

Clause 46(1)(b)(iii) is amended by adding "subject to section 18.1," before "the supervision".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Apprenticeship and Certification Act. Currently, the number of apprentices a journeyperson may supervise is set by regulation. This Bill requires a 1 to 1 supervision ratio for most trades.

A trade may continue to have a greater number of apprentices supervised by a journeyperson if a higher ratio is set by regulation for that trade before this Bill takes effect.
