THE PUBLIC HEALTH AMENDMENT ACT (BANNING COSMETIC EYE TATTOOING AND EYE JEWELLERY)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Public Health Act is amended by this Act.

The following is added after section 76:

PART 7.1

COSMETIC EYE PROCEDURES

Cosmetic eye tattoos and eye jewellery

76.1(1)

No person shall sell, offer for sale or provide, any of the following:

(a) scleral tattooing;

(b) implantation of eye jewellery under the conjunctiva.

Exception

76.1(2)

Subsection (1) does not apply to a member of a health profession who

(a) is regulated under The Regulated Health Professions Act or under an Act listed in Schedule 2 of The Regulated Health Professions Act; and

(b) complies with all applicable requirements established by their health profession.

Section 108 is amended by striking out "Parts 3 to 7" and substituting "Parts 3 to 7.1".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Public Health Act to ban cosmetic eye tattooing and the implantation of eye jewellery. The ban does not apply to health professionals who comply with their professions's requirements.
