THE LEGISLATIVE ASSEMBLY AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Legislative Assembly Act is amended by this Act.

Clause 52.6.1(1)(a) is amended by striking out "allowance paid" and substituting "allowance — other than severance allowance under item 7 of subsection 52.8(1) or section 52.21 — paid".

Subsection 52.27(1) is replaced with the following:

Report on payments to members

52.27(1)

Within 90 days after the end of each fiscal year, the Speaker must prepare a report showing the indemnities and allowances — other than amounts paid as retirement benefits — approved for payment under section 52.24 to each person who has been a member during the year.

Tabling of report

52.27(1.1)

 The Speaker must table a copy of the report in the Assembly on any of the first 15 days on which the Assembly is sitting after the report is prepared.

Subsection 52.27(2) is renumbered as subsection 52.27.1(1) and is amended by striking out everything after "Minister of Finance".

The following is added as subsections 52.27.1(2) and (3):

Reporting on amounts received

52.27.1(2)

 Within 45 days after the end of each fiscal year, the Minister of Finance must prepare a report showing the amounts reported under subsection (1).

52.27.1(3)

 The minister must table a copy of the report in the Assembly on any of the first 15 days on which the Assembly is sitting after the report is prepared.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Legislative Assembly Act to require the Speaker to report on members' indemnities and allowances instead of the Minister of Finance.

Also, severance paid to former members is no longer included in the report prepared by the Members' Allowance Office. These amounts are included in the Speaker's report.
