THE ADULT LEARNING CENTRES ACT

C.C.S.M. c. A5 amended

Section 25 of the French version of The Adult Learning Centres Act is amended by striking out "l'Assemblée législative" and substituting "la Législature".

THE ADVANCED EDUCATION ADMINISTRATION ACT

C.C.S.M. c. A6.3 amended

The Advanced Education Administration Act is amended by this section.

Subsection 2(3) of the French version is amended

(a) in clause (b), by striking out "crédits que l'Assemblée législative" and substituting "sommes que la Législature"; and

(b) in clause (f), by striking out "crédits votés à cette fin par l'Assemblée législative" and substituting "sommes affectées à cette fin par la Législature".

THE ANIMAL CARE ACT

The English version of The Animal Care Act is amended by this section.

Subsection 36(2) is amended by striking out "terms of the reference" and substituting "terms of reference".

Subsection 37(1) is amended, in the part before clause (a), by striking out "including" and substituting ", including".

THE BUDGET IMPLEMENTATION AND TAX STATUTES AMENDMENT ACT, 2020

S.M. 2020, c. 21 amended

5(1)

The Budget Implementation and Tax Statutes Amendment Act, 2020, S.M. 2020, c. 21, is amended by this section.

5(2)

The heading for Division 1 of Part 11 is amended by striking out "AND NATURAL GAS".

5(3)

Subsection 233(3) of the English version is amended in the section heading by striking out "Increases" and substituting "Increase".

5(4)

Section 234 is amended

(a) in the English version, by striking out "increases" and substituting "increase"; and

(b) by striking out "and Centra's general revenues, respectively," and substituting "general revenue".

THE CIVIL SERVICE SUPERANNUATION ACT

Subsection 1(1) of the French version of The Civil Service Superannuation Act is amended by replacing the definition "régime canadien agréé" with the following:

« régime canadien agréé » Régime constitué en vue d'offrir une pension, une retraite ou des prestations d'invalidité aux employés de l'une ou de plusieurs des entités qui suivent et auquel ils versent des cotisations en vue du provisionnement du régime :

a) le gouvernement du Canada;

b) le gouvernement d'une province ou d'un territoire du Canada;

c) un organisme gouvernemental du Canada;

d) un organisme gouvernemental d'une province ou d'un territoire du Canada;

THE CIVIL SERVICE SUPERANNUATION AMENDMENT ACT

S.M. 2020, c. 16 amended

Clause 18(3)(a) of the English version of The Civil Service Superannuation Amendment Act, S.M. 2020, c. 16, is amended by striking out "to the fund" and substituting "of the fund".

THE CONSTITUTIONAL QUESTIONS ACT

C.C.S.M. c. C180 amended

Subsection 7(1) of the French version of The Constitutional Questions Act is amended in the definition "recours" by striking out everything after "d'un recours en" and substituting "irrecevabilité d'éléments de preuve ou d'un recours consécutif à l'irrecevabilité d'éléments de preuve.".

THE COOPERATIVES ACT

The Cooperatives Act is amended by this section.

Subsection 365(3) is amended by replacing the part before clause (a) with the following:

13(1)

The Crown Corporations Governance and Accountability Act is amended by this section.

13(2)

Subsection 9(1) of the English version is amended by striking out "30 days of" and substituting "30 days after".

13(3)

Clause 10(1)(b) of the English version is amended by adding "the" before "corporation's".

13(4)

Subsection 10(3) is amended by striking out "unless the Assembly otherwise orders" and substituting ", unless the Assembly otherwise orders, and the Standing Committee must consider the report within 120 days after it is laid before the Assembly".

13(5)

Subsection 13(1) of the English version is amended by striking out "and" at the end of clause (b) and substituting "or".

THE DEFIBRILLATOR PUBLIC ACCESS ACT

C.C.S.M. c. D22 amended

14(1)

The French version of The Defibrillator Public Access Act is amended by this section.

14(2)

Subsection 1(1) is amended

(a) in the definition "fournisseur de services d'urgence", by striking out "Loi sur les centres téléphoniques de sécurité publique — service d'urgence 911" and substituting "Loi sur les centres de réception des communications d'urgence pour le service 911";

(b) by repealing the definition "service CTSP"; and

(c) by adding the following definition:

« service CRCU » S'entend au sens de la Loi sur les centres de réception des communications d'urgence pour le service 911. ("PSAP service")

Section 7 is amended, in the part before clause (a), by striking out "CTSP" and substituting "CRCU".

THE EMERGENCY 911 PUBLIC SAFETY ANSWERING POINT ACT

15(1)

The Emergency 911 Public Safety Answering Point Act is amended by this section.

15(2)

The title of the French version is replaced with "LOI SUR LES CENTRES DE RÉCEPTION DES COMMUNICATIONS D'URGENCE POUR LE SERVICE 911".

15(3)

Section 1 is amended

(a) by adding the following definition:

"emergency communication" means a telephone call or other communication made to a public safety answering point by dialling "911" or by another means supported by the public safety answering point; (« communication d'urgence »)

(b) by repealing the definition "emergency 911 telephone call";

(c) in the definition "public safety answering point" of the English version, by striking out "emergency 911 telephone calls and directs those calls" and substituting "emergency communications and directs those communications"; and

(d) in the French version,

(i) by repealing the definitions "centre téléphonique de sécurité publique" and "service CTSP", and

(ii) by adding the following definitions:

« centre de réception des communications d'urgence » Centre de communication qui reçoit des communications d'urgence et les transmet à des fournisseurs de services d'urgence. ("public safety answering point")

« service CRCU » Service ou organisation qui exploite un centre de réception des communications d'urgence dans une région quelconque de la province. ("PSAP service")

Section 2 of the French version is amended by striking out "CTSP" wherever it occurs and substituting "CRCU".

(b) by replacing clause (c) with the following:

(c) use or permit another person to use a telephone or other communication device to make a false, frivolous or vexatious emergency communication.

THE MANITOBA HYDRO ACT

17(1)

The Manitoba Hydro Act is amended by this section.

17(2)

Subsection 46(2) is amended by adding ", and the Standing Committee must consider the report within 120 days after it is laid before the Assembly" at the end.

17(3)

Section 52 is amended

(a) in subclause (a)(iii) of the English version, by striking out "persons" and substituting "persons,";

(b) in clause (c) of the English version, by striking out "of property, plant and works" and substituting "of, property, plant and works,"; and

(c) in clause (d), by striking out "The Energy Savings Act or".

THE LIQUOR, GAMING AND CANNABIS CONTROL ACT

C.C.S.M. c. L153 amended

Section 101.1 of the French version of The Liquor, Gaming and Cannabis Control Act is amended in the definition "commande à distance" by striking out "placée" and substituting "passée".

THE PROVINCIAL PARKS ACT

Subsection 22(1) of The Provincial Parks Act is amended by striking out "or under The Provincial Park Lands Act, R.S.M. 1987, c. P20".

THE PROTECTING AND SUPPORTING CHILDREN (INFORMATION SHARING) ACT

C.C.S.M. c. P143.5 amended

20(1)

The French version of The Protecting and Supporting Children (Information Sharing) Act is amended by this section.

20(2)

The preamble is amended

(a) in the second paragraph, by striking out "les services pour enfants et pour" and substituting "services pour les enfants et"; and

(b) in the third paragraph, by striking out "des services" and substituting "services".

20(3)

Subsection 9(1) is amended by striking out "à son examen exhaustif" and substituting "à l'examen exhaustif de la présente loi".

THE PUBLIC HEALTH ACT

C.C.S.M. c. P210 amended

21(1)

The Public Health Act is amended by this section.

21(2)

Subsection 14(1) is replaced with the following:

Report on health status of Manitobans

In 2021, 2025 and at least once every five years after 2025, the chief public health officer must give the minister a report on the health status of Manitobans.

21(3)

Section 94 of the English version is amended by striking out "and" at the end of clause (b).

THE QUEEN'S COUNSEL ACT

C.C.S.M. c. Q5 amended

Section 3 of The Queen's Counsel Act is amended by replacing everything before clause (b) with the following:

Eligibility for appointment

A lawyer is eligible to be appointed if the lawyer is currently a practising member of The Law Society of Manitoba and has or had

(a) held a practising certificate for at least 10 years in any common law jurisdiction or Quebec;

THE REAL PROPERTY ACT

23(1)

The Real Property Act is amended by this section.

Subsection 45(5) is amended

(a) in clause (h.1), by striking out "section 12 of The Energy Savings Act or"; and

(b) in the English version, by striking out "and" at the end of clause (j).

23(3)

Clause 111(1)(b) is amended by striking out "MTS Allstream Inc." and substituting "The Bell Telephone Company of Canada, or Bell Canada,".

THE RED TAPE REDUCTION AND GOVERNMENT EFFICIENCY ACT, 2018

S.M. 2018, c. 29 amended

Subsection 26(8) of The Red Tape Reduction and Government Efficiency Act, 2018, S.M. 2018, c. 29, is amended by striking out "The Highways and Transportation Act" and substituting "The Transportation Infrastructure Act".

THE REGIONAL HEALTH AUTHORITIES ACT

THE REGULATED HEALTH PROFESSIONS ACT

The Regulated Health Professions Act is amended by this section.

26(2)

Subsection 56(2) is amended, in the part before clause (a), by striking out "the registrar or board of assessors, as the case may be," and substituting "the person or body responsible for registering, licensing, certifying or qualifying members of that college".

26(3)

Subsection 56(6) of the English version is amended by striking out "practise the regulated health profession" and substituting "practise their regulated health profession".

26(4)

Clause 65(2)(c) of the English version is amended by adding "or" at the end of subclause (ii).

Clause 5(b) of the French version of The Workplace Safety and Health Act is replaced with the following:

The French version of The City of Winnipeg Charter, S.M. 2002, c. 39, is amended by this section.

Subsection 189(2) is amended, in the part before clause (a), by striking out "dont appel" and substituting "visé".

Subsection 495(2) is amended by striking out "dont appel" and substituting "visée".

COMING INTO FORCE

Coming into force

35(1)

Subject to this section, this Act comes into force on the day it receives royal assent.

Coming into force — section 10

35(2)

Section 10 is deemed to have come into force on October 14, 2020.

Coming into force — section 24

35(3)

Section 24 is deemed to have come into force on July 1, 2019.

This Bill corrects typographical, numbering and other drafting errors. It also makes minor amendments to various Acts.
