HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE MANITOBA LIQUOR AND LOTTERIES CORPORATION ACT

1(1)

The Manitoba Liquor and Lotteries Corporation Act is amended by this section.

1(2)

Section 34 is replaced with the following:

Liquor vendor agreement

The corporation may — by written agreement and on the terms specified by the corporation — authorize a person to sell the types of liquor specified in the agreement from a location set out in the agreement.

The Liquor, Gaming and Cannabis Control Act is amended by this section.

2(2)

Section 23 is amended by repealing the definition "liquor store".

2(3)

The following is added after clause 35(a):

(a.1) liquor vendor licence;

Subsection 36(1) is amended by striking out "or section 34".

2(5)

Subsection 36(2) is amended by striking out "sell liquor" and substituting "sell all types of liquor".

The following is added after section 36:

Liquor vendor licence

36.1(1)

A liquor vendor licence may be issued to a person who has entered into an agreement with MLLC under section 34 of The Manitoba Liquor and Lotteries Corporation Act.

Authorized sales

36.1(2)

A liquor vendor licence authorizes the licensee to sell the types of liquor specified in the licence on a retail basis from the premises specified in the licence. The licence may specify only the types of liquor that are set out in the agreement between the licensee and MLLC.

TRANSITIONAL AND COMING INTO FORCE

Transitional — rural liquor vendors

3(1)

If, on the coming into force of this Act, a rural liquor vendor holds a valid liquor store licence, that licence

(a) is deemed to be a liquor vendor licence that authorizes the sale of all types of liquor; and

(b) continues to be valid until it expires, unless it is cancelled or suspended beforehand.

3(2)

In subsection (1), "rural liquor vendor" means a person who entered into an agreement with the Manitoba Liquor and Lotteries Corporation under section 34 of The Manitoba Liquor and Lotteries Corporation Act as it read before the coming into force of this Act.

Coming into force

This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

This Bill amends The Manitoba Liquor and Lotteries Corporation Act and The Liquor, Gaming and Cannabis Control Act.

The Bill enables the Manitoba Liquor and Lotteries Corporation (MLLC) to enter into an agreement with a third party to sell the types of liquor set out in the agreement from a specified location. Currently, the MLLC may only enter into agreements that authorize third parties to sell liquor in rural areas.

The Liquor, Gaming and Cannabis Authority of Manitoba will issue a new class of retail liquor licence to third parties who enter into these agreements with the MLLC.
