THE WORKERS COMPENSATION AMENDMENT ACT (COVID-19 PRESUMPTIVE COVERAGE)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Workers Compensation Act is amended by this Act.

The following is added after subsection 4(5):

Presumption re COVID-19

4(5.0.1)

If a worker tests positive for the communicable disease known as COVID-19 within 14 days after attendance at their usual place of employment, the person's infection must be presumed to be an accident arising out of and in the course of the employment, unless the contrary is proven.

Effective date of presumption re COVID-19

4(5.0.2)

The presumption in subsection (5.0.1) applies to a worker who tests positive for COVID-19 on or after March 1, 2020.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

Under The Workers Compensation Act, certain injuries are presumed to be caused by a worker's employment. This Bill extends that presumption to workers who test positive for COVID-19 within two weeks after attending their workplace.
