THE LIQUOR, GAMING AND CANNABIS CONTROL AMENDMENT AND MANITOBA LIQUOR AND LOTTERIES CORPORATION AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE LIQUOR, GAMING AND CANNABIS CONTROL ACT

1(1)

The Liquor, Gaming and Cannabis Control Act is amended by this section.

1(2)

The following is added after section 24:

Liquor sales with delivery and takeout food orders

24.1(1)

The holder of a prescribed category of liquor service licence may sell beer, wine, cider and coolers for consumption outside the licensed premises if it is sold with food purchased for delivery or takeout from the licensed premises.

Sales must comply with regulations

24.1(2)

The sale of beer, wine, cider and coolers sold with food for consumption outside the licensed premises must take place in accordance with the regulations.

1(3)

The following is added after subsection 47(1):

Liquor must be purchased from MLLC

47(1.1)

All liquor sold under a retail endorsement must have been purchased from MLLC.

1(4)

The following is added after clause 157(2)(e):

(e.1) establishing requirements and prohibitions respecting the sale of beer, wine, cider and coolers for consumption outside of licensed premises under section 24.1;

THE MANITOBA LIQUOR AND LOTTERIES CORPORATION ACT

2(1)

The Manitoba Liquor and Lotteries Corporation Act is amended by this section.

2(2)

Clause 28(1)(c) is amended by striking out "(beer distributor)" and substituting "(liquor distributor)".

2(3)

Section 36 is replaced with the following:

Liquor distributor agreement

36(1)

The corporation may enter into an agreement with a person to act as a liquor distributor.

Authorized activities

36(2)

A person who enters into a liquor distributor agreement may, in accordance with the agreement,

(a) acquire liquor and sell it to the corporation;

(b) store liquor in Manitoba; and

(c) deliver liquor as directed by the corporation.

COMING INTO FORCE

Coming into force — royal assent

3(1)

Subject to subsection (2), this Act comes into force on the day it receives royal assent.

Coming into force — proclamation

3(2)

Subsections 1(2) and (4) come into force on a day to be fixed by proclamation.

Explanatory Note

This Bill amends The Liquor, Gaming and Cannabis Control Act. The holder of a specified type of liquor service licence may sell beer, wine, cider and coolers to customers who order food for delivery or takeout from the licensed premises.

In addition, all liquor sold by the holder of a liquor manufacturer's licence with a retail endorsement must have been purchased from Manitoba Liquor and Lotteries Corporation.

The Manitoba Liquor and Lotteries Corporation Act is also amended. Manitoba Liquor and Lotteries Corporation may enter into a liquor distribution agreement with third parties. Currently, beer is the only product that can be distributed by third parties.
