THE LEGISLATIVE ASSEMBLY AMENDMENT AND LEGISLATIVE ASSEMBLY MANAGEMENT COMMISSION AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. L110 amended

1(1)

The Legislative Assembly Act is amended by this section.

1(2)

The definition "recognized opposition party" in section 1 is replaced with following:

"recognized opposition party" means the members of the Assembly who belong to a political party that is represented in the Assembly by

(a) four or more members, or

(b) not fewer than two members, provided the party's endorsed candidates obtained, in total, at least 10% of all the valid votes in the most recent general election,

but that is not the party with the largest number of members or the official opposition; (« parti d'opposition reconnu »)

2(1)

The Legislative Assembly Management Commission Act is amended by this section.

2(2)

The definition "other opposition party" in section 1 is replaced with following:

"other opposition party" means an opposition party, other than the official opposition, that is represented in the Assembly by

(a) four or more members, or

(b) not fewer than two members provided the party's endorsed candidates obtained, in total, at least 10% of all the valid votes in the most recent general election; (« autre parti d'opposition »)

TRANSITIONAL PROVISIONS

Limited application

3(1)

This section applies until the commissioner makes a regulation under section 52.12 of The Legislative Assembly Act that takes effect after the coming into force of this section.

No funding for political party or member under Legislative Assembly Act

3(2)

Despite the definition "recognized opposition party" in The Legislative Assembly Act, as enacted by subsection 1(2) of this Act,

(a) a political party that, on the day this section comes into force, is represented in the Assembly by fewer than four members is not considered to fall within that definition for the purpose of funding under that Act; and

(b) a member of that political party on the day this section comes into force is not entitled to any additional salary or allowance that would be payable to the member if the party were a recognized opposition party.

No funding for political party under Legislative Assembly Management Commission Act

3(3)

Despite the definition "other opposition party" in The Legislative Assembly Management Commission Act, as enacted by subsection 2(2) of this Act, a political party that, on the day this section comes into force, is represented in the Assembly by fewer than four members is not considered to fall within that definition for the purpose of funding under that Act.

COMING INTO FORCE

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Legislative Assembly Act and The Legislative Assembly Management Commission Act. The definition "recognized opposition party" and the definition "other opposition party" are changed to include political parties that are represented in the Assembly by two or more members, provided that the party's candidates received at least 10% of the votes cast in the last general election. Such a party and its members are not immediately entitled to any additional funding, salaries or allowances.
