THE LIQUOR, GAMING AND CANNABIS CONTROL AMENDMENT ACT (CANNABIS SOCIAL RESPONSIBILITY FEE)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Liquor, Gaming and Cannabis Control Act is amended by this Act.

The following is added after subsection 101.3(2):

Agreement must include a social responsibility fee

101.3(3)

It is a term of every agreement under this section that the person with whom the agreement is entered into must pay to the government, at the time and in the manner specified in the agreement, a social responsibility fee in respect of the person's sales of cannabis in 2019 and in each year after that.

Amount of fee

101.3(4)

The amount of the social responsibility fee is

(a) the prescribed amount; or

(b) if no amount is prescribed, 6% of the person's annual gross revenue received or receivable in the year from their Manitoba sales of cannabis.

The following is added after clause 157(1)(i):

(j) for the purpose of section 101.3, prescribing the amount of the social responsibility fee or the manner of determining the amount of the fee.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

To operate a cannabis store in Manitoba, a person must enter into an agreement with the Minister of Growth, Enterprise and Trade or the Manitoba Liquor and Lotteries Corporation.

This Bill amends The Liquor, Gaming and Cannabis Control Act to make it a term of the agreement that the operator of a cannabis store must pay to the government a social responsibility fee. The fee is 6% of the operator's annual cannabis sales revenue or the amount set by regulation.
