THE LABOUR RELATIONS AMENDMENT ACT (RIGHT TO COLLECTIVE BARGAINING)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Labour Relations Act is amended by this Act.

The preamble is amended by adding the following at the end:

AND WHEREAS the government recognizes that individual employees typically lack the power to bargain and pursue workplace goals with their more powerful employers;

AND WHEREAS the government recognizes that, as a result, section 2 of the Canadian Charter of Rights and Freedoms guarantees all employees the right to a meaningful process of collective bargaining;

AND WHEREAS this guarantee protects employees' right to join together with sufficient independence and choice to determine and pursue their workplace goals;

AND WHEREAS this guarantee protects employees' right to make collective representations to their employer, to have those representations considered in good faith and to have recourse should the employer not bargain in good faith;

AND WHEREAS the right to strike is an essential part of a meaningful collective bargaining process in our system of labour relations;

The enacting clause is amended by adding "THEREFORE" before "HER MAJESTY".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends the preamble of The Labour Relations Act to reflect the government's recognition that section 2 of the Canadian Charter of Rights and Freedoms guarantees a meaningful collective bargaining process and to set out components of that guarantee.
