THE INSURANCE AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Insurance Act is amended by this Act.

The following is added after subsection 165(2):

No denial if death because of medical assistance in dying

165(3)

If the death of a person whose life is insured results from receiving medical assistance in dying as defined in section 241.1 of the Criminal Code (Canada), the death is not to be considered to be the result of suicide and the insurer cannot rely on a provision in the contract that provides that it is void or the amount payable under it is reduced in the event of suicide.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Insurance Act. If a person insured under a life insurance policy dies as the result of medical assistance in dying, the death is not a suicide and the insurer cannot rely on a provision in the contract that would deny or reduce benefits in the case of suicide.
