THE HIGHWAY TRAFFIC AMENDMENT ACT (SAFER TRAFFIC CONDITIONS FOR CYCLISTS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

2(1)

Subsection 114(1) is amended

(a) by replacing clause (a) with the following:

(a) shall pass to the left of the vehicle or bicycle at a safe distance, and in the case of overtaking a bicycle or power-assisted bicycle, shall to the extent possible maintain at least a one-metre separation between the vehicle and the bicycle or power-assisted bicycle; and

(b) in clause (b) of the French version, by striking out "suffisante du véhicule ou une" and substituting "sécuritaire du véhicule ou de la".

The following is added after subsection 114(1):

Overtaking on the right

114(1.1)

Subsection (1) applies, with necessary changes, when a driver is permitted by this Act to overtake on the right

(a) another vehicle, including a power-assisted bicycle; or

(b) a bicycle.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

The Highway Traffic Act requires a driver to maintain a safe distance when passing a vehicle or a bicycle. This Bill amends the Act to specify that, when possible, the distance must be at least one metre when passing a bicycle or a power-assisted bicycle.
