HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Mental Health Act is amended by this Act.

2(1)

Subsection 15(1) is amended by adding "or a qualified person" after "for another peace officer".

The following is added after subsection 15(3):

Definition: "qualified person"

In this section, "qualified person" means a person who holds a position specified in the regulations or who has received training specified in the regulations.

The following is added after clause 125(1)(d):

(d.1) for the purpose of the definition "qualified person" in subsection 15(4), specifying a position or category of positions that a person may hold in order to be qualified, or the training required to be qualified;

Coming into force

This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

The Mental Health Act requires a peace officer to take a person to a facility for an involuntary medical examination or psychiatric assessment and to stay with the person until the examination or assessment has been completed. This Bill enables someone who is not a peace officer but who has been appointed to a specified position, or who has received the required training, to stay with the person at the facility until the examination or assessment has been completed.
