THE RESIDENTIAL TENANCIES AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Residential Tenancies Act is amended by this Act.

The following is added after section 62:

Duty to use energy-efficient appliances

62.1(1)

Except in prescribed circumstances, when a landlord replaces a major appliance in a rental unit, he or she must replace it with an appliance that, at the time it is purchased or leased,

(a) is listed as being "ENERGY STAR qualified" or "ENERGY STAR certified" by the Office of Energy Efficiency, Natural Resources Canada; or

(b) meets a prescribed energy efficiency standard.

Definition: "major appliance"

62.1(2)

In this section, "major appliance" means

(a) a clothes washer;

(b) a clothes dryer;

(c) a refrigerator;

(d) a dishwasher;

(e) a residential water heater; or

(f) a residential boiler or furnace.

Duty to use water-efficient toilets

62.2

Except in prescribed circumstances, when a landlord replaces a toilet in a rental unit, he or she must replace it with a toilet that meets a prescribed water efficiency standard at the time it is purchased or leased.

Coming into force

This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

This Bill amends The Residential Tenancies Act. When a landlord replaces a major appliance in a rental unit, he or she must replace it with an appliance that meets established energy efficiency standards. When a toilet is replaced, the landlord must replace it with a toilet that meets water efficiency standards established by regulation.
