HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Foreign Cultural Objects Immunity from Seizure Act is amended by this Act.

Section 1 is amended

(a) in the part before clause (a), by striking out everything after "before the work or object is brought into Manitoba" and substituting "the minister who is charged with the administration of this Act determines"; and

(b) in the part after clause (b), by striking out "the Order in Council" and substituting "notice of the minister's determination".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

The Foreign Cultural Objects Immunity from Seizure Act provides that certain foreign works of art or cultural objects will be protected from seizure while in Manitoba. That protection is triggered by a determination that the work or object is culturally significant or that its temporary exhibit or display is of interest to Manitobans. Currently, the determination must be made by Cabinet and set out in an Order in Council. This Bill allows the minister to make the determination rather than Cabinet.
