THE COOPERATIVE HOUSING STRATEGY ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"cooperative housing" means housing provided by housing cooperatives. (« habitation coopérative »)

"housing cooperative" means a housing cooperative as defined in The Cooperatives Act. (« coopérative d'habitation »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

Purpose

The purpose of this Act is to promote, stimulate and sustain cooperative housing by developing and implementing a cooperative housing strategy.

Cooperative housing strategy to be developed

Within 12 months after the coming into force of this Act, the minister must develop a cooperative housing strategy, after consulting in accordance with section 7.

Principles to guide strategy

The cooperative housing strategy must be based on the following principles:

Consultation: Given the participatory nature of cooperatives, consulting about the strategy is necessary.

Diversification: Promoting a variety of cooperative housing financial and organizational models is necessary to diversify the cooperative housing sector, and to raise and maintain the profile of cooperative housing in Manitoba.

Cooperative Advantage: The strategy should consider the member and community benefits specific to cooperatives since housing cooperatives are distinct from other types of housing.

Contents of strategy

The cooperative housing strategy must include goals, objectives and activities to promote, stimulate and sustain cooperative housing in Manitoba.

Strategy reviewed every five years

The cooperative housing strategy must be reviewed by the minister at least once every five years, after consulting in accordance with section 7.

Consultation on strategy

In developing and reviewing the cooperative housing strategy, the minister must consult with

(a) persons who are members of housing cooperatives;

(b) persons who are cooperative sector representatives; and

(c) any other persons, organizations or entities that the minister considers appropriate.

Publication

The minister must ensure that a description of the cooperative housing strategy is published on a government website.

Annual report on strategy

9(1)

Within six months after the end of each fiscal year, the minister must prepare a report on the progress made and the activities undertaken in relation to implementing the strategy in the previous year.

9(2)

The minister must include the report prepared under subsection (1) in the annual report of the department over which the minister presides.

Delegation by minister

The minister may, in writing, delegate any power conferred or duty imposed on the minister under this Act

(a) to an employee of the department over which the minister presides; or

(b) to The Manitoba Housing and Renewal Corporation.

This Act may be referred to as chapter C221 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires the minister to develop a cooperative housing strategy and review it at least every five years. The minister is to consult when developing and reviewing the strategy. In addition, the minister must report annually on the progress made and the activities undertaken in relation to implementing the strategy.
