HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. P310 amended

1           The Manitoba Institute of the Purchasing Management Association of Canada Act is amended by this Act.

2           The title is replaced with "THE SUPPLY CHAIN MANAGEMENT PROFESSIONALS ACT".

3           Section 1 is amended

(a) by repealing the definitions "certified professional purchaser" and "purchaser"; and

(b) by adding the following definitions:

"reserved abbreviations" means the following abbreviations:

(a) SCMP,

(b) p.g.c.a.,

(c) C.P.P.,

(d) a.p.a.; (« abréviation réservée »)

"reserved designations" means the following designations:

(a) "Supply Chain Management Professional",

(b) "professionnel en gestion de la chaîne d'approvisionnement",

(c) "Certified Professional Purchaser",

(d) "approvisionneur professionnel agréé"; (« titre réservé »)

"supply chain management" means the planning and management of activities involved in the sourcing and procurement of goods or services, including transportation and logistics management relating to those goods or services; (« gestion de la chaîne d'approvisionnement »)

"supply chain management professional" means a person who

(a) is engaged for hire, gain or hope of reward, either directly or indirectly, in supply chain management, and

(b) is a member of the Institute and holds a class of membership under the Institute's by-laws that permits the person to use

(i) one or more of the reserved designations, and

(ii) one or more of the reserved abbreviations after his or her name. (« professionnel en gestion de la chaîne d'approvisionnement »)

4            Subsection 5(1) is replaced with the following:


5(1)        The Institute must grant membership in the Institute to an individual who applies in accordance with the by-laws and has paid the fees prescribed by the by-laws, if

(a) the individual

(i) has complied with the academic and experience requirements specified in the by-laws for the granting of membership of the class applied for,

(ii) has passed any examinations, and met any other qualifications, that the board of directors has prescribed in accordance with the by-laws, and

(iii) is of good character; or

(b) the individual is entitled to be granted membership by virtue of The Labour Mobility Act.

5           Subsection 9(8) of the English version is amended by striking out "sections 8" and substituting "section 8".

6(1)        Subsection 10(1) is amended in the part before clause (a) by striking out "who considers himself".

6(2)        Subsection 10(6) is amended by striking out everything after "shall not use" and substituting "a reserved designation, or a reserved abbreviation after his or her name, within the province."

7           Section 11 is amended by striking out "the designation "Certified Professional Purchaser" and shall not use after his or her name the initials "C.P.P." within" and substituting "a reserved designation or a reserved abbreviation within".

8           Section 13 is replaced with the following:

Reserved designations and abbreviations

13          A supply chain management professional may — in accordance with the Institute's by-laws relating to the use of reserved designations and reserved abbreviations for the person's class of membershipuse a reserved designation, or a reserved abbreviation after his or her name.

Prohibition on use of designations and abbreviations

13.1(1)      Subject to section 14, no person other than a supply chain management professional shall

(a) use a reserved designation or a reserved abbreviation, alone or in combination with any other word, name, title or description; or

(b) imply, suggest or hold out that he or she is a supply chain management professional.

Offence and penalty

13.1(2)     A person who contravenes subsection (1) is guilty of an offence and is liable on summary conviction

(a) for a first offence, to a fine of not more than $500; and

(b) for a second or subsequent offence, to a fine of not more than $1,000.

9           Section 14 is replaced with the following:

Rights of persons other than supply chain management professionals

14          Nothing in this Act or the Institute's by-laws affects or interferes with the right of any person who is not a supply chain management professional

(a) to practise in supply chain management; or

(b) to use a reserved abbreviation so long as the person is not practising in supply chain management.

10          Section 16 is amended by striking out "chapter P310" and substituting "chapter S233".

Transitional provision

11          A person registered as a certified professional purchaser immediately before the coming into force of this Act is deemed to be registered as a supply chain management professional, holding a class of membership as determined in accordance with the by-laws.

Coming into force

12          This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

This Bill changes the title of The Manitoba Institute of the Purchasing Management Association of Canada Act to The Supply Chain Management Professionals Act.

Other amendments include replacing the professional designation of "certified professional purchaser" with "supply chain management professional", and adding a provision referencing the Institute's obligations under The Labour Mobility Act.
