THE PORTAGE DIVERSION COMPENSATION ACT (WATER RESOURCES ADMINISTRATION ACT AMENDED)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Water Resources Administration Act is amended by this Act.

Section 1 is amended

(a) in the definition "designated water control work", by striking out "or" at the end of clause (a) and by adding the following after clause (a):

(a.1) the Portage Diversion, or

(b) by adding the following definition:

"Portage Diversion" means the land and structures described as such in the regulations; (« canal Portage »)

Clause 26(1)(f.2) is amended by adding "and the Portage Diversion" after "Shellmouth Dam".

Coming into force and transitional

Subject to subsection (2), this Act comes into force on the day it receives royal assent.

This Act is retroactive to the extent necessary to allow claims for compensation to be made and resolved under sections 12.1 to 12.6 of The Water Resources Administration Act in relation to flooding that occurred in 2011.

Explanatory Note

This Bill designates the Portage Diversion as a "designated water control work" under The Water Resources Administration Act.

The designation means that compensation claims for flood damage and economic loss may be made in relation to the Portage Diversion in the same way that claims can now be made respecting the operation of the Red River Floodway and the Shellmouth Dam.

The Bill is retroactive to the extent necessary to allow victims of the 2011 flood to claim compensation.
