THE MUNICIPAL AMENDMENT AND CITY OF WINNIPEG CHARTER AMENDMENT ACT (DEFAMATION PROTECTION)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
PART 1
THE MUNICIPAL ACT
The Municipal Act is amended by this Part.
Subsection 403(2) is repealed.
The following is added after section 403:
Members' statements subject to absolute privilege
Any statement made or document used by a member of a council at a council meeting or at a meeting of a council committee is subject to an absolute privilege.
PART 2
THE CITY OF WINNIPEG CHARTER
The City of Winnipeg Charter is amended by this Part.
Subsection 497(2) is repealed.
The following is added after section 497 and before the centred heading "INSURANCE":
DEFAMATION PROTECTION
Members' statements subject to absolute privilege
Any statement made or document used by a member of council at a council meeting or at a meeting of a committee of council is subject to an absolute privilege.
PART 3
COMING INTO FORCE
This Act comes into force on the day it receives royal assent.
Explanatory Note This Bill protects municipal council members from defamation claims for statements made at council meetings. |
