THE RENEWABLE ENERGY JOBS ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"eligible manufacturer" means a corporation or partnership that carries on, or is established to carry on, in Manitoba, the business of manufacturing equipment, components or construction materials

(a) for use in the production, generation, transmission or distribution of renewable energy, including hydroelectricity; or

(b) for use in the processing of renewable resources used in the production of renewable energy. (« fabricant admissible »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

Program established

2(1)

A government program to be known as the "Renewable Energy Jobs Funding Program" is hereby established.

Purpose of program

2(2)

The purpose of the program is to provide support in accordance with this Act to eligible manufacturers.

Loans

3(1)

With the approval of the Lieutenant Governor in Council, the minister may enter into an agreement with an eligible manufacturer to provide financial support, by way of a loan, for the purposes specified in the agreement.

Delegation to Manitoba Development Corporation

3(2)

The Lieutenant Governor in Council may authorize or direct Manitoba Development Corporation, the corporation continued under The Development Corporation Act, to enter into the loan agreement or to administer it, or both.

Other support

4(1)

In addition to, or instead of, providing financial support by means of a loan under section 3, the minister may provide any other form of support to eligible manufacturers in accordance with the regulations.

Regulations

4(2)

The Lieutenant Governor in Council may make regulations respecting other forms of support, which may include performance bonds or loan guarantees, to eligible manufacturers.

Source of funding

Advances to be made under loan agreements made under section 3, and any other payments to be made in accordance with the regulations, are payable by the Minister of Finance out of the Consolidated Fund from money authorized by an Act of the Legislature for those purposes.

Annual report

For each fiscal year, the report of the department over which the minister presides must include a report about the Renewable Energy Jobs Funding Program that includes summary information about

(a) the loans made under section 3;

(b) any other support provided under section 4; and

(c) the jobs created by eligible manufacturers that can reasonably be attributed to the support provided under the program.

This Act may be referred to as chapter R85 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill establishes the Renewable Energy Jobs Funding Program. It provides support to Manitoba-based manufacturers of equipment, components or construction materials used in producing, generating, transmitting or distributing renewable energy or to process renewable resources used in producing renewable energy.

Funding may be provided by way of loan agreements. Other forms of support may be provided in accordance with the regulations.

The minister must report annually about the program.
