THE POLICE SERVICES AMENDMENT ACT (POLICE BOARDS FOR SMALLER MUNICIPALITIES)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Police Services Act, as enacted by S.M. 2009, c. 32, is amended by this Act.

The following is added after subsection 29(1):

No application if council designated as police board

29(1.1)

Subsection (1) does not apply if the council as a whole has been designated as the police board under clause 30(3.1)(a).

3(1)

The following is added after subsection 30(3):

Police board for municipalities with a population less than 200,000

30(3.1)

Despite subsections (1) and (2), the council of a municipality with a population of less than 200,000 may, by by-law, establish its police board by designating

(a) the council as a whole; or

(b) a council committee consisting of at least three members;

as the municipality's police board.

3(2)

Subsection 30(4) is amended by adding "— except where a council or a council committee has been designated as the police board under subsection (3.1) —" after "the police board".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Police Services Act by providing that municipalities having a population of less than 200,000 may designate the municipal council, or a committee of the council, as the municipality's police board.
