THE ELECTIONS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Elections Act is amended by this Act.

Subsection 22(2) is repealed.

Section 23 is replaced with the following:

Appointing chief electoral officer

The chief electoral officer must be appointed by the Lieutenant Governor in Council

(a) on the recommendation of the Standing Committee on Legislative Affairs; and

(b) following a resolution of the Assembly carried by a vote of more than two-thirds of the members voting.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

Under this Bill, a person may be appointed as chief electoral officer only after the appointment has been recommended by the Standing Committee on Legislative Affairs and approved by a vote of more than two-thirds of the members of the Assembly who vote.
