THE UNIVERSITY COLLEGE OF THE NORTH AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The University College of the North Act is amended by this Act.

Subclause 5(1)(a)(i) is amended by striking out ", who is a non-voting member".

Subsection 10(1) is renumbered as subsection 10(1.1) and is amended

(a) by repealing clauses (e) and (f); and

(b) by replacing everything before clause (a) with the following:

Without limiting subsection (1), the Governing Council may

The following is added as subsection 10(1):

Role of the Governing Council

The Governing Council has overall responsibility for the university college, and may determine all matters of university college policy except those specifically assigned to the Learning Council by this Act.

Clause 12(b) is repealed.

5(1)

Subsection 14(1) is replaced with the following:

Learning Council responsible for academic policy

14(1)

The Learning Council is responsible for the academic policy of the university college.

Clauses 14(2)(b) and (c) are repealed.

Subsection 14(3) is amended by replacing everything before clause (b) with the following:

Powers of Learning Council

14(3)

Without limiting subsection (1), the Learning Council may

(a) consider and determine the courses or programs to be offered;

(a.1) set criteria concerning

(i) qualifications for admission,

(ii) examinations and evaluations of student performance,

(iii) requirements for graduation, and

(iv) awards recognizing academic excellence;

(a.2) evaluate existing courses or programs;

(a.3) determine the degrees, honorary degrees, certificates and diplomas to be granted by the university college, and the persons to whom they are to be granted;

(a.4) establish faculty councils, school councils and other bodies within the university college, specify how they are to be constituted, and assign to them the powers and duties that the Learning Council determine;

Section 21 and the centred heading before it are repealed.

Section 23 is amended by striking out "June 30" and substituting "March 31".

Coming into force

This Act comes into force on July 1, 2010.

Explanatory Note

This Bill gives the Learning Council responsibility for the academic policy of the University College of the North.

Additionally, the chancellor becomes a voting member of the Governing Council instead of a non-voting member. The financial year-end of the university college is also moved from June 30 to March 31.
