THE MANITOBA ASSOCIATION OF SCHOOL TRUSTEES AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

R.S.M. 1990, c. 240 amended

The Manitoba Association of School Trustees Act, R.S.M. 1990, c. 240, is amended by this Act.

The title is replaced with "THE MANITOBA SCHOOL BOARDS ASSOCIATION ACT".

Section 1 is amended

(a) in the definition "association", by striking out "The Manitoba Association of School Trustees" and substituting "The Manitoba School Boards Association"; and

(b) in the definition "board", by striking out "and includes the Central Advisory Committee of The Frontier School Division".

Section 2 is replaced with the following:

Association continued

The Manitoba Association of School Trustees is continued as a body corporate under the name The Manitoba School Boards Association.

Subsection 6(1) is amended by striking out "person" and substituting "trustee".

Subsection 6(2) is amended by adding "The Manitoba Association of School Trustees,"after "president of".

Subsection 7(1) is replaced with the following:

Composition of executive

The executive of the association is to consist of

(a) the president;

(b) two vice-presidents, of whom one must be from a school division or district in which 6,000 or more pupils are enrolled and the other must be from a school division or district in which fewer than 6,000 pupils are enrolled;

(c) the immediate past president; and

(d) any other director elected or appointed to the executive of the association in accordance with the by-laws of the association.

Subsection 7(3) of the French version is amended by striking out "de l'ancien président immediat" and substituting "du président sortant".

Section 8 is amended by striking out "vice-president, and" and substituting "vice-presidents and".

Section 11 is replaced with the following:

Officers

The officers of the association are the president, the vice-presidents, the immediate past president, and such other officers as the by-laws of the association may prescribe.

Section 15 is replaced with the following.

Report to be presented at annual convention

At each annual convention,

(a) the president, or member of the executive designated by the president, must present the association's annual report for the immediately preceding fiscal year, which must include the financial statements for the year and the auditor's report on those statements; and

(b) the members of the association must appoint an auditor for the current year.

Coming into force

This Act comes into force on the day it receives royal assent.
