THE ELECTIONS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Elections Act is amended by this Act.

Clauses 53(2)(f) and 188(2)(b), section 184 and subsection 191(3) are amended by striking out "sections 178 to 183" and substituting "sections 178 to 183.1".

The following is added after section 183:

Offence re election signs

183.1

A person who unlawfully takes down, covers up, mutilates, defaces or alters a sign or poster set up or displayed by or on behalf of a candidate is guilty of an offence.

Subsection 185(1) is replaced with the following:

Penalty for serious offences

185(1)

A person who is guilty of an offence under

(a) sections 178 to 183 is liable on summary conviction to a fine of not more than $10,000., or to imprisonment for a term of not more than one year, or both; and

(b) section 183.1 is liable on summary conviction to both a fine of not less than $500. and not more than $2,000. and imprisonment for a term of not less than 24 hours and not more than one year.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill makes it an offence to vandalize election signs of candidates in provincial elections.  A person convicted of this offence is subject to a minimum fine and a period of imprisonment.
