THE HIGHWAY TRAFFIC AMENDMENT ACT (BOOSTER SEATS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

The following is added after subsection 186(9):

Child booster seats required

186(9.1)

No person shall operate, or permit the operation of, a motor vehicle on a highway unless every passenger in the vehicle who has not yet attained the age of eight years is properly secured in a booster seat of a kind prescribed in the regulations.  As an exception, the child is not required to be secured in that manner if he or she is at least 145 cm in height or 36 kg in weight.

Clause 186(14)(a) is amended by adding "and booster seats" at the end.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill ensures that a child who is under 8 years of age is to be properly secured in a booster seat while riding in a vehicle.  An exception is made for children who are at least 145 cm in height or 36 kg in weight.
