THE LIQUOR CONTROL AMENDMENT ACT (LIQUOR VENDOR SITING)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Liquor Control Act is amended by this Act.

The following is added after subsection 17(1):

Commission's own stores in other municipalities not to be considered

17(1.1)

In considering under subsection (1) whether to deem any part of a rural area as being at such a distance from an existing liquor store that it is desirable that, for the convenience of the inhabitants of the area, a place for the sale of liquor be established, the commission must not, despite any agreement to the contrary, have regard to a liquor store operated by the commission that is in a municipality other than the municipality in which the liquor vendor would be located.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Liquor Control Act to provide that the Liquor Control Commission must not have regard to its own liquor stores in neighbouring municipalities in determining whether a proposed private liquor vendor is a sufficient distance from other liquor stores to warrant its establishment.
