THE SALVATION ARMY GRACE GENERAL HOSPITAL INCORPORATION AMENDMENT ACT


Explanatory Note

(Assented to                                         )

WHEREAS The Salvation Army Grace General Hospital was incorporated by a private Act of the Legislature;

AND WHEREAS under the authority of that private Act, the corporation operated The Salvation Army Grace General Hospital, and continues to operate The Salvation Army Golden West Centennial Lodge;

AND WHEREAS the ownership and operation of The Salvation Army Grace General Hospital have been transferred to the Winnipeg Regional Health Authority under The Regional Health Authorities Act, which will continue to operate the facility as a hospital;

AND WHEREAS the private Act under which The Salvation Army Grace General Hospital was incorporated should be amended to reflect these changes;

AND WHEREAS The Governing Council of The Salvation Army in Canada consents to this amending Act;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Salvation Army Grace General Hospital Incorporation Act is amended by this Act.

The title is replaced with "THE SALVATION ARMY GOLDEN WEST CENTENNIAL LODGE INCORPORATION ACT".

The preamble is amended

(a) in the fifth paragraph of the English version, by striking out "has"; and

(b) by adding the following as a sixth paragraph:

AND WHEREAS the corporation transferred the ownership and operation of The Salvation Army Grace General Hospital, effective April 1, 2008, to the Winnipeg Regional Health Authority pursuant to The Regional Health Authorities Act;

Subsection 1(1) is replaced with the following:

The corporation is continued under the name The Salvation Army Golden West Centennial Lodge (hereinafter called the "corporation").

Clause 1(2)(a) is repealed.

4(3)

Clause 1(2)(b) is amended by adding "in Winnipeg," after "The Elderly and Infirm Persons' Housing Act,".

Clause 2(1)(c) is amended

(a) by repealing subclause (i); and

(b) in subclause (ii), by adding "in Winnipeg," after "The Elderly and Infirm Persons' Housing Act,".

Subsection 3(1) is amended by striking out "not less than 14 nor more than 25 individuals" and substituting "not less than 10 nor more than 15 individuals".

Clauses 4(2)(b) and (c) are replaced with the following:

(b) The Strategic Planning Committee;

(c) The Quality Committee;

Section 5 is amended by

(a) renumbering it as subsection 5(1); and

(b) repealing clause (a).

The following is added after subsection 5(1):

Approval by The Governing Council

A by-law, rule or regulation under subsection (1) is not effective until it is approved in writing by The Governing Council of The Salvation Army in Canada.

Coming into force

This Act is deemed to have come into force on April 1, 2008.

Explanatory Note

The Salvation Army Grace General Hospital Incorporation Act is the Private Act authorizing The Salvation Army to operate the facilities commonly known as the Grace Hospital and the Golden West Centennial Lodge personal care home.  On April 1, 2008, the Grace Hospital was transferred to the Winnipeg Regional Health Authority, which will continue to operate the facility as a hospital.  To reflect that change, this Bill amends the Act to

  • change the title to The Salvation Army Golden West Centennial Lodge Incorporation Act; and
  • remove all references to the hospital.

The Bill also contains a few minor updates to the corporate governance provisions.
