THE MUNICIPAL WATER SYSTEM PHOSPHORUS CONTROL ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
Phosphorus-based lead control products prohibited
A municipality must not
(a) use a phosphorus-based substance; or
(b) cause or permit another person to use a phosphorus-based substance;
to control the leaching of lead into water pipes in the municipal water distribution system.
A municipality that contravenes section 1 is guilty of an offence and is liable on summary conviction,
(a) for a first offence, to a fine of not more than $500,000; and
(b) for each subsequent offence, to a fine of not more than $1,000,000.
If a contravention of this Act continues for more than one day, the municipality is guilty of a separate offence for each day the contravention continues.
If a provision of this Act conflicts with another Act, the provision of this Act prevails.
This Act may be referred to as chapter M267 of the Continuing Consolidation of the Statutes of Manitoba.
This Act comes into force nine months after the day it receives royal assent.
Explanatory Note This Bill prohibits a municipality from using phosphorus-based substances to control the leaching of lead into the water pipes of a municipal water distribution system. |
