HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Phosphorus-based lead control products prohibited

1           A municipality must not

(a) use a phosphorus-based substance; or

(b) cause or permit another person to use a phosphorus-based substance;

to control the leaching of lead into water pipes in the municipal water distribution system.


2           A municipality that contravenes section 1 is guilty of an offence and is liable on summary conviction,

(a) for a first offence, to a fine of not more than $500,000; and

(b) for each subsequent offence, to a fine of not more than $1,000,000.

Continuing offence

3           If a contravention of this Act continues for more than one day, the municipality is guilty of a separate offence for each day the contravention continues.

Conflict with other Acts

4           If a provision of this Act conflicts with another Act, the provision of this Act prevails.

C.C.S.M. reference

5           This Act may be referred to as chapter M267 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

6           This Act comes into force nine months after the day it receives royal assent.

Explanatory Note

This Bill prohibits a municipality from using phosphorus-based substances to control the leaching of lead into the water pipes of a municipal water distribution system.
