THE HIGHWAY TRAFFIC AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
1 The Highway Traffic Act is amended by this Act.
2 Section 146 is replaced with the following:
146(1) No person shall ride, or permit any other person to ride, on
(a) the exterior of a vehicle; or
(b) any other portion of a vehicle not designed or intended to be ridden on.
146(2) Subsection (1) does not apply to a person riding
(a) on the regular seat of a moped, motorcycle, farm tractor, implement of husbandry, special mobile machine, off-road vehicle or power-assisted bicycle;
(b) on a vehicle used for fire fighting;
(c) on a vehicle engaged in highway construction or maintenance;
(d) on a sanitation vehicle, if the person occupies a stand affixed to the vehicle for the purpose of carrying a sanitation employee;
(e) on a vehicle in a caravan, motorcade, parade, rally or other special event that the relevant traffic authority has authorized or permitted; or
(f) in the box of a truck, if
(i) the person is working and the nature of his or her occupation requires that he or she rides in the box of a truck,
(ii) the truck is a farm truck being used as authorized under section 180, or
(iii) the truck is being used in a part of northern Manitoba exempted from the application of subsection (1) by regulation.
146(3) The minister may make regulations exempting all or any part of northern Manitoba from the application of subsection (1).
146(4) In this section, "northern Manitoba" means the part of Manitoba that is north of the northern boundary of township 21 and is not within a municipality.
3 This Act comes into force on the day it receives royal assent.
This Bill prohibits people from riding on the outside of a vehicle or any other part of it that is not designed to be occupied. A number of exceptions are provided.
