THE MILK PRICES REVIEW AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Milk Prices Review Act is amended by this Act.

2(1)

Subsection 3(5) is replaced with the following:

Monitoring and fixing of prices

3(5)

The commission shall monitor prices of fluid milk charged by distributors, jobbers, manufacturers, processors and retailers, and by order

(a) shall establish a fixed price at which one or more types of fluid milk shall be sold by retailers in the province; and

(b) without limiting clause (a), may establish

(i) a minimum price, a maximum price, or both, at which one or more types of fluid milk shall be sold by distributors, jobbers, manufacturers, processors or retailers, and

(ii) the areas of the province within which the prices established under subclause (i) shall apply.

2(2)

Subsection 3(6) is amended by striking out "and" at the end of clause (a) and adding the following after clause (a):

(a.1) without limiting clause (a), the cost of distributing milk to retail outlets throughout the province; and

Subsection 3(7) is amended

(a) in clause (a), by striking out "subsection (5)" and substituting "clause (5)(a) or (b)"; and

(b) in clause (b), by striking out "that subsection" and substituting "clause (5)(a) or (b)".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires the Manitoba Milk Prices Review Commission to establish a fixed price for at least one type of fluid milk that is to be charged by retailers throughout the province.
