THE MANITOBA MUSEUM AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
The Manitoba Museum Act is amended by this Act.
Section 1 is amended by striking out "(hereinafter called the "museum")".
Section 12 is replaced with the following:
The board of the corporation may make any by-law it considers necessary for the purposes of the corporation.
Section 13 is amended
(a) by striking out "Any by-law, rule, or regulation" and substituting "A by-law"; and
(b) by striking out ", or any repeal, amendment, or alteration of any such by-law, rule, or regulation,".
Sections 14 and 15 are replaced with the following:
The affairs of the corporation are to be administered by a board consisting of 12, 14 or 16 members of the corporation, as fixed from time to time by a resolution of the board.
One-half of the members of the board are to be elected as provided in the by-laws of the corporation.
One-half of the members of the board are to be appointed by the Lieutenant Governor in Council. Each is to hold office for the term fixed in his or her appointment, which must not exceed three years.
A member appointed under this section continues to hold office until he or she is reappointed, the appointment is revoked or a successor is appointed.
The Lieutenant Governor in Council may fill a vacancy on the board for a member who was appointed under this section by appointing a person to fill the unexpired term of the former member.
Transitional: existing members of the board
A member of the board
(a) who was appointed or elected to the board before the coming into force of this Act; and
(b) whose term of office has not expired on the coming into force of this Act;
continues to hold office for the unexpired portion of his or her term and may be reappointed or re-elected, as the case may be.
This Act comes into force on a day to be fixed by proclamation.
This Bill amends The Manitoba Museum Act as to the size of the board and the appointment of board members. It also modernizes the provisions about the board's authority to make by-laws.
