THE PUBLIC SCHOOLS AMENDMENT ACT (REGIONAL VOCATIONAL SCHOOLS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
1 The Public Schools Act is amended by this Act.
2(1) The following is added after subsection 49(2):
49(2.1) If an agreement under subsection (1) is or will be terminated but a school division that was a party to it wishes the regional vocational school to continue,
(a) the minister may enter into an agreement with the school division and the governing board to continue the regional vocational school; and
(b) the minister and the school board may, pursuant to the agreement and despite subsection (2), name persons who are not trustees to serve as members of the governing board of the regional vocational school.
2(2) Subsections 49(3) and (4) are amended by striking out "under an agreement made under subsection (1)" and substituting "or continued under an agreement made under this section".
2(3) Subsection 49(5) is replaced with the following:
49(5) The parties to an agreement made under this section may enter into subsidiary agreements with each other — and in the case of an agreement under subsection (1) that establishes a governing board to administer the regional vocational school, with the board — respecting the provision of supplies and services.
2(4) Subsection 49(6) is amended
(a) by striking out "subsection (1) in" and substituting "this section in"; and
(b) by striking out "subsection (1) or (5)" and substituting "this section".
3 The definition "recognized educational institution" in section 1 of The Adult Learning Centres Act is amended by striking out "under subsection 49(1)" and substituting "or continued under section 49".
4 This Act comes into force on the day it receives royal assent.
This Bill enables the minister and a school division to agree to continue a regional vocational school.
