THE MEDICAL AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Medical Act is amended by this Act.

The following is added after section 36:

Non-traditional therapies

36.1

Despite section 36, Parts VIII to X and the regulations and by-laws, a member shall not be found guilty of professional misconduct or of incompetence solely on the basis that the member practises a therapy that is non-traditional or departs from the prevailing medical practice unless there is evidence that proves that the therapy poses a greater risk to a patient's health than the traditional or prevailing practice.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Medical Act. It allows physicians more flexibility to practise non-traditional therapies and other therapies that differ from prevailing medical practice, without the potential for professional discipline unless the non-traditional or differing therapy involves a greater risk to patient health.
