THE AGROLOGISTS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Agrologists Act is amended by this Act.

2(1)

Subsection 1(1) is amended by adding the following definition:

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)

Subsection 1(2) is amended by adding the following after clause (g):

(h) any other person who is deemed by regulation not to be practising agrology when the person carries on an activity prescribed by regulation in accordance with any conditions or restrictions prescribed by regulation.

The following is added after subsection 1(2):

Regulations by minister

The minister may make regulations

(a) deeming certain persons or classes of persons not to be practising agrology when they carry on an activity prescribed by regulation in accordance with any conditions or restrictions prescribed by regulation;

(b) prescribing activities that may be carried on by certain persons or classes of persons for the purposes of clause (2)(h) and prescribing any conditions or restrictions that apply to the activities.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

The Agrologists Act requires persons who practise agrology to be members of the Manitoba Institute of Agrologists. Subsection 1(2) of the Act sets out a list of exceptions to this requirement.

This Bill permits the Minister of Agriculture, Food and Rural Initiatives to make regulations to add to the list of exceptions persons who carry on activities prescribed in the regulations.
