THE MANITOBA LOTTERIES CORPORATION AMENDMENT ACT


Explanatory Note

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Manitoba Lotteries Corporation Act is amended by this Act.

Section 3 is amended in the part before clause (a) by striking out "The corporation may" and substituting "Subject to section 3.1, the corporation may".

The following is added after section 3:

Requirement to reduce video lottery terminals

3.1(1)

Beginning in 2004, the corporation shall annually reduce the number of video lottery terminals in use in the province in accordance with the following formula:

R = 0.2 x V

In this formula,

R   is the number of video lottery terminals that must be decommissioned in the year for which the calculation is made;

V   is the number of video lottery terminals in use in Manitoba on September 1, 2001, excluding those in use in the casinos known as Club Regent and McPhillips Street Station and in casinos operated by First Nations under the authority of this Act.

Provincial casinos and First Nations casinos exempted

3.1(2)

Subsection (1) does not apply to video lottery terminals in use in the casinos known as Club Regent and McPhillips Street Station or in casinos operated by First Nations under the authority of this Act.

Annual reduction to be completed by year end

3.1(3)

The corporation must complete the reduction required by subsection (1) in respect of a particular year on or before December 31 of the year.

Reduction to be applied pro rata to siteholders

3.1(4)

The corporation shall make the reduction required by subsection (1) in respect of each year pro rata among its siteholders, within the meaning of the regulations under this Act.

Deemed termination of siteholder agreement

3.1(5)

Seven days before the corporation reduces the number of video lottery terminals in a siteholder's possession to zero under subsections (1) and (4), it is deemed to give the siteholder notice of termination of his or her siteholder agreement without cause.  The siteholder agreement is deemed to terminate on the day on which the corporation removes the last video lottery terminal from the siteholder's premises.

New or replacement video lottery terminals

3.1(6)

Except as provided by subsection (7), the corporation shall not acquire a new type of video lottery terminal or replace an obsolete type of terminal until the minister tables in the Assembly a report that contains an analysis of the economic impacts in Manitoba of the acquisition or replacement, and of any alternatives to the acquisition or replacement.  The report must also contain an analysis of any economic or social impacts of the acquisition or replacement on families and individuals in Manitoba.

Exception for unserviceable video lottery terminals

3.1(7)

Subsection (6) does not prohibit the replacement of a malfunctioning video lottery terminal that is no longer serviceable, if the corporation must replace it to comply with the terms of a siteholder agreement.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires The Manitoba Lotteries Corporation to eliminate the use of video lottery terminals in Manitoba over a five-year period after the Bill comes into force.  Video lottery terminals used in government-run casinos and First Nations' casinos are not affected.  The Bill also restricts the Corporation's power to obtain new types of video lottery terminals or to replace obsolete types.
