THE TAXPAYER PROTECTION LEGAL REPRESENTATION ACT
(LEGAL AID SERVICES SOCIETY OF MANITOBA ACT AMENDED)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Legal Aid Services Society of Manitoba Act is amended by this Act.

2(1)

Section 1 is amended by renumbering it as subsection 1(1) and by adding the following as subsection 1(2):

Criminal organizations and members ineligible

1(2)

Despite any provision of this Act or the regulations, the following are not eligible for legal aid in respect of any civil or criminal matter:

(a) an organization that the society reasonably believes is a criminal organization as defined in subsection 467.1(1) of the Criminal Code (Canada); and

(b) a person who the society reasonably believes is a member or associate of such an organization who has received income or property from the organization.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Legal Aid Services Society Act by making criminal organizations ineligible for legal aid.  It also makes ineligible members and associates of a criminal organization who receive income or property from the organization.
