AN ACT TO AMEND AN ACT TO INCORPORATE THE PORTAGE DISTRICT GENERAL HOSPITAL FOUNDATION

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
An Act to Incorporate the Portage District General Hospital Foundation is amended by this Act.
The second paragraph of the preamble is replaced with the following:
AND WHEREAS it is deemed desirable to create a corporation to receive donations of property, real or personal, in trust for charitable purposes for the benefit of the Portage District General Hospital, the Douglas Campbell Lodge Personal Care Home, and the Regency House Elderly Persons Housing Unit, and for the care, benefit and comforts of patients and residents of those facilities and, if considered necessary, to provide responsible trustees to have the custody and management of any property so donated;
Section 2 is replaced with the following:
The members of the corporation shall be the persons who are appointed to the board of directors under subsection 4(2).
Subsection 4(2) is replaced with the following:
The board of directors shall consist of five persons who must all be residents of Manitoba and shall be appointed as follows:
(a) two appointed by the council of The City of Portage la Prairie;
(b) two appointed by the council of The Rural Municipality of Portage la Prairie; and
(c) one appointed by the other members of the board, who shall then become the chief executive officer of the corporation.
Subsection 4(4) is replaced with the following:
Any vacancy on the board of directors shall be filled as provided for in subsection (2).
The following is added after section 4:
The board of directors may, subject to clause 4(2)(c), appoint such officers and establish such committees as they deem advisable.
The corporation shall manage and invest its assets, procure donations, and expend its income and capital for the purpose of enhancing health care, health research, health education and health program development in the following facilities in The City of Portage la Prairie:
(a) Portage District General Hospital;
(b) Douglas Campbell Lodge Personal Care Home;
(c) Regency House Elderly Persons Housing Unit.
Subsection 7(1) is repealed.
This Act comes into force on the day it receives royal assent.
