THE HEARING AID AMENDMENT ACT


Explanatory Note

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Hearing Aid Act is amended by this Act.

In the following provisions of the English version, "his" is struck out wherever it occurs and "his or her" is substituted:

(a) section 1;

(b) subsection 7(2);

(c) subsection 13(2);

(d) section 14; and

(e) clauses 17(2)(a) and (b).

Section 2 of the English version is amended

(a) by striking out "chairman" and substituting "chair" in clause (2)(a) and subsections (3) and (5); and

(b) by striking out "his" and substituting "his or her" in clause (2)(b).

Clause 2(2)(d) is replaced with the following:

(d) four persons appointed by the minister, at least one of whom shall be a hearing aid dealer.

Subsection 2(5) is amended by striking out "three members" and substituting "four members".

Section 4 is amended by striking out "he" and substituting "the dealer".

Subsection 5(1) of the English version is amended by striking out "application for licence" and substituting "application for a licence".

Clauses 8(1)(c) and (d) of the English version are amended by striking out "his certification" and substituting "the certification of the person against whom the complaint was made".

Section 9 is replaced with the following:

Written reasons for cancellation, etc.

If the director refuses to grant or renew a licence or cancels a licence under section 7, he or she shall give the applicant or licensee written reasons.

Clause 12(1)(b) of the English version is amended by adding "or herself" after "himself".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Hearing Aid Act by increasing the number of ministerial appointees on The Hearing Aid Board from two to four.

This Bill also modernizes the language of several provisions in the Act.
