HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
PART 1
GENERAL
THE CERTIFIED GENERAL ACCOUNTANTS ACT
The Certified General Accountants Act is amended by this section.
The title of the French version of the Act is amended by striking out "LICENCIÉS" and substituting "ACCRÉDITÉS".
The definition "Association" in section 1 of the French version is amended by striking out "licenciés" and substituting "accrédités".
The definition "cabinet de comptables" in section 1 of the French version is repealed and the following is substituted:
« cabinet de comptables » ou « cabinet de comptables à responsabilité limitée » Corporation titulaire d'un permis valide. ("professional corporation")
Clause (a) of the definition "certificat" in section 1 of the French version is amended by striking out "licencié" and substituting "accrédité".
The definition "comptable général licencié" in section 1 of the French version is amended by striking out "licencié" and substituting "accrédité".
Subsection 2(1) of the French version is amended by striking out "licenciés" and substituting "accrédités".
In the following provisions of the French version "licencié" is struck out and "accrédité" is substituted:
(a) clause 6(1)(e);
(b) subsections 9(1) and (3), wherever it occurs.

Clause 11.3(1)(b) and subsection 11.5(1) of the French version are amended

Subclause 11.9(2)(d)(ii) of the English version is amended by striking out "more for" and substituting "for more".
THE CHARTERED ACCOUNTANTS ACT
The Chartered Accountants Act is amended by this section.
The definition "cabinet de comptables" in section 1.1 of the French version is repealed and the following is substituted:
« cabinet de comptables » ou « cabinet de comptables à responsabilité limitée » Corporation titulaire d'un permis valide. ("professional corporation")
Subsection 20(1) of the French version is amended
(a) in clause (e), by striking out "de la corporation" and substituting "du cabinet"; and
(b) in clause (f), by striking out "la corporation" and substituting "du cabinet".
Subclause 34(2)(c)(ii) of the French version is amended by striking out "la cabinet" and substituting "le cabinet".
THE COMMODITY FUTURES ACT
Subsection 61(1) of the English version of The Commodity Futures Act is amended by adding "the" after "similar to this Act,".
THE CONSTRUCTION INDUSTRY WAGES ACT
The Construction Industry Wages Act is amended by this section.
The definition "heavy construction employees" in section 1 of the English version is amended by striking out "or" at the end of clause (b).
The definition "minister" in section 1 is repealed and the following is substituted:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
Subsection 6(2) is amended in the part before clause (a) by striking out "employees employed in the heavy construction sector of the construction industry" and substituting "heavy construction employees".
Subsection 12(4) is amended
(a) in the section heading, by striking out "Act" and substituting "Code"; and
(b) in the subsection, by striking out "The Employment Standards Act" and substituting "The Employment Standards Code".
Subsection 14(4) is amended
(a) in the section heading, by striking out "Payment of Wages Act" and substituting "Employment Standards Code"; and

Subsection 18(2) is amended
(a) in the section heading by striking out "Payment of Wages Act" and substituting "Employment Standards Code"; and
(b) in the subsection

Section 19.1 is amended by striking out "Act" and substituting "Code".
THE COURT OF QUEEN'S BENCH SMALL CLAIMS PRACTICES ACT
The Court of Queen's Bench Small Claims Practices Act is amended by this section.
Clause 21(1)(c) is amended by striking out "and accompanied by an official "acknowledgment of receipt" form".
Subsection 21(3) is amended by striking out "thereof as shown on the "acknowledgement of receipt" form signed by the person acknowledging receipt thereof" and substituting "confirmed by Canada Post Corporation".
THE DENTAL ASSOCIATION ACT
The Dental Association Act is amended by this section.
The definition "cabinet de dentistes" in section 1 of the French version is repealed and the following is substituted:
« cabinet de dentistes » ou « cabinet de dentistes à responsabilité limitée » Corporation titulaire d'un permis valide. ("dental corporation")
In the following provisions of the French version,"à responsabilité limitée" is added after "dentistes":
(a) clause 23.3(1)(b);
Clause 23.8(2)(a) of the French version is amended by striking out "de dentistes".
THE MANITOBA EVIDENCE ACT
Subsection 64(4) of the English version of The Manitoba Evidence Act is amended by striking out "inacapable" and substituting "incapable".
THE DEPARTMENT OF HEALTH ACT
Section 9 of The Department of Health Act is repealed.
THE HIGHWAY TRAFFIC AMENDMENT, OFF-ROAD VEHICLES AMENDMENT AND CONSEQUENTIAL AMENDMENTS ACT
Section 26 of The Highway Traffic Amendment, Off-Road Vehicles Amendment and Consequential Amendments Act, S.M. 1999, c. 12, is repealed.
THE HIGHWAY TRAFFIC AMENDMENT AND SUMMARY CONVICTIONS AMENDMENT ACT
Subsection 1(3) of The Highway Traffic Amendment and Summary Convictions Amendment Act, S.M. 1999, c. 43, is repealed and the following is substituting:
Subsection 279(1.4) is amended by adding ", section 273.2.1 (default in fine or restitution order)" after "(default in maintenance)".
THE DEPARTMENT OF LABOUR ACT
Section 9 of The Department of Labour Act is repealed.
THE LAW SOCIETY ACT
The Law Society Act is amended by this section.
The definition "cabinet d'avocats" in section 1 of the French version is repealed and the following is substituted:
« cabinet d'avocats » ou « cabinet d'avocats à responsabilité limitée » Corporation titulaire d'un permis valide délivré en vertu de l'article 61.3. ("law corporation")
Section 36 of the English version is amended by adding "or" at the end of subclause (o)(xii).
Subsection 61.2(2) of the French version is amended
(a) in the section heading, by adding "membres d'une société" after "Cabinets d'avocats";
(b) in the part before clause (a), by adding "à responsabilité limitée" after "cabinets d'avocats" wherever it occurs; and

Section 54 of the French version of The Life Leases and Consequential Amendments Act, S.M. 1998, c. 42, is amended by striking out "Loi sur le paiement des salaires" and substituting "Code des normes d'emploi".
THE MEDICAL ACT
The Medical Act is amended by this section.
The definition "cabinet de médecins" in section 1 of the French version is repealed and the following is substituted:
« cabinet de médecins » ou « cabinet de médecins à responsabilité limitée » Corporation titulaire d'une licence valide délivrée en application de l'article 22. ("medical corporation")
Clause 22(1)(b) of the French version is amended by adding "à responsabilité limitée" after "médecins".
Subsection 23(1) of the French version is amended by adding "à responsabilité limitée" after "médecins".
Subsection 31(5) is amended by striking out "lay councillors" and substituting "councillors who are public representatives".
Subsection 31(7) is amended
(a) in the section heading, by striking out "lay councillors" and substituting "public representatives"; and

THE MEDICAL AMENDMENT ACT
Subsection 11(2) of the English version of The Medical Amendment Act, S.M. 1999, c. 39, is amended by adding "to" after "continue".
THE MINES AND MINERALS ACT
Subsection 213(1) of The Mines and Minerals Act is amended by striking out "judicial district" and substituting "judicial centre".
THE MUNICIPAL ACT
Subsection 184(5) of the French version of The Municipal Act is amended by striking out "licenciés" and substituting "accrédités".
AN ACT TO GOVERN THE SUPPLY OF NATURAL GAS IN MANITOBA
AND TO AMEND THE PUBLIC UTILITIES BOARD ACT
Sections 1 and 31 of An Act to Govern the Supply of Natural Gas in Manitoba and to Amend The Public Utilities Board Act, S.M. 1987-88, c. 65, are repealed.
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
The Manitoba Public Insurance Corporation Act is amended by this section.
Subsection 1(1) is amended
(a) by repealing the definition "general manager"; and
(b) by adding the following definition in alphabetical order:
"chief executive officer" means the president and chief executive officer of the corporation appointed under this Act; (« directeur général »)
Section 4 of the English version is amended
(a) by striking out "general manager" and substituting "chief executive officer" in the section heading and in the section; and
(b) by adding "or her" after "his".
Section 5 of the English version is amended by striking out "general manager" and substituting "chief executive officer" in the section heading and wherever it occurs in the section.
Subsection 20(4) of the English version is amended
(a) by striking out "general manager" and substituting "chief executive officer" wherever it occurs in the section; and
(b) by adding "or her" after "his".
Subsection 20(5) of the English version is amended
(a) by striking out ", general manager, or other officer" and substituting "or the chief executive officer or other officer"; and

Section 193 of the English version is amended by striking out "general manager" and substituting "chief executive officer".
THE PUBLIC SECTOR COMPENSATION MANAGEMENT ACT
The Public Sector Compensation Management Act, S.M. 1991-92, c. 44, is repealed.
THE PUBLIC SECTOR REDUCED WORK WEEK AND COMPENSATION MANAGEMENT ACT
The Public Sector Reduced Work Week and Compensation Management Act, S.M. 1993, c. 21, is repealed.
THE REGIONAL WASTE MANAGEMENT AUTHORITIES ACT
Subsection 17(2) of the French version of The Regional Waste Management Authorities Act is amended by striking out "licenciés" and substituting "accrédités".

The Cattle Producers Association Act is amended by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food" in the following provisions:

THE CONSERVATION AGREEMENTS ACT

THE DYKING AUTHORITY ACT
Clause 10(b) of The Dyking Authority Act is amended by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".
THE EMERGENCY MEASURES ACT
The definition "local authority" in section 1 of The Emergency Measures Act is amended
(a) in clause (e), by striking out "Minister of Northern Affairs" and substituting "Minister of Aboriginal and Northern Affairs; and

THE EMPLOYMENT STANDARDS CODE

THE HIGHWAY TRAFFIC ACT
The Highway Traffic Act is amended by this section.
Clause (a) of the definition "traffic authority" in subsection 1(1) is amended by striking out "Minister of Highways" and substituting "minister".
In the following definitions, "The Highways and Transportation Department Act" is struck out and "The Highways and Transportation Act" is substituted:
(a) in subsection 1(1),
(i) "industrial road", and
(ii) "provincial highway";
(b) in subsection 68(1),
(i) "provincial road", and
(ii) "provincial trunk highway".
Subsection 297(1) is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
THE HIGHWAYS AND TRANSPORTATION CONSTRUCTION CONTRACTS DISBURSEMENT ACT
The Highways and Transportation Construction Contracts Disbursement Act is amended by this section.
The definition "department" in section 1 is amended by striking out "Department of Highways and Transportation" and substituting "department of government over which the minister presides and through which this Act is administered".
The definition "minister" in section 1 is amended by striking out "Minister of Highways and Transportation" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE HORSE RACING REGULATION ACT
The Horse Racing Regulation Act is amended by this section.
Subsection 2(1) is amended in the section heading and in the subsection by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food".
Subsection 2(2) is amended by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food".
THE HOUSING AND RENEWAL CORPORATION ACT
The Housing and Renewal Corporation Act is amended by this section.
Subsection 6(3) is amended by striking out "Department of Housing" and substituting "Department of Family Services and Housing".
The English version of the section heading of subsection 23(1) is repealed and "Incorporation of housing authorities" is substituted.
THE LAND ACQUISITION ACT
Subsection 10(3) of The Land Acquisition Act is amended by striking out "Minister of Natural Resources to be dealt with under The Crown Lands Act" and substituting "minister appointed by the Lieutenant Governor in Council to administer The Crown Lands Act, to be dealt with under that Act".
THE LAND REHABILITATION ACT
The definition "minister" in section 1 of The Land Rehabilitation Act is repealed and the following is substituted:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
THE LIQUOR CONTROL ACT
The Liquor Control Act is amended by this section.
Clause (d) of the definition "local authority" in subsection 1.1(1) is amended by striking out "Minister of Northern Affairs" and substituting "Minister of Aboriginal and Northern Affairs".
THE MARGARINE ACT
The Margarine Act is amended by this section.
The definition "inspector" in section 1 is amended by striking out "The Department of Agriculture" and substituting "the department of government over which the minister presides and through which this Act is administered".
The definition "minister" in section 1 is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE MINING CLAIM TAX ACT
Sections 3 and 4 of The Mining Claim Tax Act are amended by striking out "Minister of Energy and Mines" and substituting "Minister of Industry, Trade and Mines".
THE MUNICIPAL ACT
The Municipal Act is amended by this section.
In the following provisions, "Minister of Northern Affairs" is struck out wherever it occurs and "Minister of Aboriginal and Northern Affairs" is substituted:
(a) subsection 5(1), in the definition "unorganized territory in Northern Manitoba";
(b) subsection 6(1);
(c) subsection 6(3), in the section heading and in the subsection;
Subsection 73(1) is amended by striking out "Minister of Urban Affairs" and substituting "minister".
Subsection 290(2) is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
Clause 292(b) is amended by striking out "Minister of Natural Resources"" and substituting "Minister of Conservation".
THE MUNICIPAL BOARD ACT
Subsection 96(2) of The Municipal Board Act is amended by striking out "Minister of Natural Resources"" and substituting "Minister of Conservation".
AN ACT RESPECTING DEBTS OWING BY MUNICIPALITIES TO SCHOOL DISTRICTS
The definition "minister" in section 1 of An Act Respecting Debts Owing by Municipalities to School Districts is amended by striking out "Minister of Rural Development" and substituting"minister appointed by the Lieutenant Governor in Council to administer this Act".
THE NATURAL PRODUCTS MARKETING ACT
The Natural Products Marketing Act is amended by this section.
Clauses 7(a), (d) and (f) are amended
(a) by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food"; and
(b) by striking out "Minister of Natural Resources" and substituting "Minister of Conservation".
Subsection 38(3) is amended by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food".
THE NOXIOUS WEEDS ACT
The Noxious Weeds Act is amended by this section.
Section 1 is amended by adding the following definition in alphabetical order:
"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)
The definition "minister" in section 1 is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
Subsections 3(3) and (4) are amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
Subsection 11(3) is amended by striking out "The Department of Agriculture" and substituting "the department".
Section 15 is amended by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".
Subsection 38(1) is amended by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food".
THE OFF-ROAD VEHICLES ACT
The Off-Road Vehicles Act is amended by this section.
The definition "departmental road" in subsection 1(1) is amended
(a) in the French version, by striking out "au sens d" and substituting "au sens de"; and
(b) in the English version, by striking out "The Department of Public Works Act" and substituting "The Public Works Act".

Clause 155(a) is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
THE PROVINCIAL PARKS ACT
Clause 27(1)(b) of The Provincial Parks Act is amended by striking out "Minister of Highways and Transportation" and substituting "Minister of Highways and Government Services".
THE PESTICIDES AND FERTILIZERS CONTROL ACT
The definition "minister" in section 1 of The Pesticides and Fertilizers Control Act is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE PLANNING ACT
Clause (c) of the definition "council" in section 1 of The Planning Act is amended by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".
THE PLANT PESTS AND DISEASES ACT
The definition "minister" in section 1 of The Plant Pests and Diseases Act is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
Subsection 27(1) of The Manitoba Public Insurance Corporation Act is amended by striking out "The Department of Highways and Transportation" and substituting "the Department of Highways and Government Services".
THE PUBLIC SCHOOLS ACT
The Public Schools Act is amended by this section.
In the following provisions, "Minister of Northern Affairs" is struck out wherever it occurs and "Minister of Aboriginal and Northern Affairs" is substituted:
(a) in clause (c) of the definition "council" in section 171;
(b) in clause 172(b);
(c) in the part of subsection 191(1) before clause (a).
Subsection 177(2) is amended
(a) by striking out ""Minister of Northern Affairs" and substituting "Minister of Aboriginal and Northern Affairs"; and
(b) by striking out "Department of Northern Affairs" and substituting "Department of Aboriginal and Northern Affairs".
THE PUBLIC SCHOOLS FINANCE BOARD ACT
Section 7 of The Public Schools Finance Board Act is amended by striking out "Department of Rural Development" and substituting "Department of Intergovernmental Affairs".
THE PUBLIC WORKS ACT
The Public Works Act is amended by this section.
The definition "public work" in section 1 is amended in the part after clause (b),
(a) by striking out "The Highways and Transportation Department Act" wherever it occurs and substituting "The Highways and Transportation Act"; and
(b) by striking out "Minister of Highways and Transportation" and substituting "Minister of Highways and Government Services".
The definition "work" in section 1 is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
THE REAL PROPERTY ACT
Section 28 of The Real Property Act is amended by striking out "Minister of Natural Resources" and substituting "Minister of Conservation".
THE RESIDENTIAL TENANCIES ACT
Subsection 180(1) of The Residential Tenancies Act is amended by striking out "Minister of Northern Affairs" and substituting " Minister of Aboriginal and Northern Affairs".
THE RETAIL BUSINESSES HOLIDAY CLOSING ACT
In the following provisions of The Retail Businesses Holiday Closing Act, "Minister of Northern Affairs" is struck out wherever it occurs and "Minister of Aboriginal and Northern Affairs" is substituted:
(a) clause (d) of the definition "council" in section 1;
(b) clause (d) of the definition "municipality" in section 1;
(c) subsection 4.1(1).
THE RURAL DEVELOPMENT BONDS ACT
In the following provisions of The Rural Development Bonds Act, "Minister of Northern Affairs" is struck out wherever it occurs and "Minister of Aboriginal and Northern Affairs" is substituted:
(a) the definition "municipality" in subsection 1(1);
(b) subclause 3(1)(f)(ii);

THE SEED AND FODDER RELIEF ACT
The definition "minister" in section 1 of The Seed and Fodder Relief Act is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE SOLDIERS' TAXATION RELIEF ACT
The Soldiers' Taxation Relief Act is amended by this section.
Section 1 is amended by adding the following definition in alphabetical order:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
In the following provisions "Minister of Rural Development" is struck out and "minister" is substituted:
(a) the definition "taxes" in section 1;
(b) subsections 4(1) and 5(1);
(c) sections 7 and 8;
(d) subsections 9(1) and (3).
THE SPECIAL SURVEY ACT
Subsections 19(2), (3) and (4) of The Special Survey Act are amended by striking out "Minister of Rural Development" wherever it occurs and substituting "Minister of Intergovernmental Affairs".
THE SURVEYS ACT
Section 6 of The Surveys Act is amended by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".
THE TRANS-CANADA HIGHWAY ACT
Section 2 of The Trans-Canada Highway Act is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
THE UNCONDITIONAL GRANTS ACT
The following provisions of The Unconditional Grants Act are amended by striking out "Minister of Rural Development" wherever it occurs and substituting "Minister of Intergovernmental Affairs":
(a) subsections 3(2) to 3(5);
(b) clause 8(a).
THE VETERINARY SCIENCE SCHOLARSHIP FUND ACT
The definition "minister" in section 1 of The Veterinary Science Scholarship Fund Act is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
THE WATER RESOURCES ADMINISTRATION ACT
Clause 7(f) of The Water Resources Administration Act is amended by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".
THE WILDFIRES ACT
Clause 20(3)(b) of The Wildfires Act is amended by striking out "The Highways and Transportation Department Act" and substituting "The Highways and Transportation Act".
THE WOMEN'S INSTITUTES ACT
The Women's Institutes Act is amended by this section.
The definition "department" in section 1 is repealed.
The definition "minister" in section 1 is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".
PART 3
COMING INTO FORCE
This Act, except sections 13, 15 and 49, comes into force the day it receives royal assent.
Section 13 is retroactive and deemed to have come into force on December 1, 1999.
Section 15 is retroactive and deemed to have come into force on January 1, 2000.
Section 49 comes into force on the day The Highways Protection and Consequential Amendments Act, S.M. 1992, c. 38 comes into force.
