THE MANITOBA ETHNOCULTURAL ADVISORY AND ADVOCACY COUNCIL ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
1 In this Act,
"advocate" means to promote the priorities of the ethnocultural community in Manitoba; (« formuler des revendications »)
"council" means the Manitoba Ethnocultural Advisory and Advocacy Council established in section 2; (« Conseil »)
"ethnocultural group or organization" means an ethnocultural group or organization recognized by the minister; (« organisation ou groupe ethnoculturel »)
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)
2 The "Manitoba Ethnocultural Advisory and Advocacy Council" is established.
3 The purpose of the council is to advocate on behalf of the ethnocultural community in Manitoba and provide information, advice and recommendations to the government, through the minister, on all ethnocultural matters in the province, including anti-racism, education, human rights, immigration, settlement and cultural and linguistic diversity and heritage.
4(1) The council shall consist of a maximum of 21 members appointed by the minister. The appointments are to include
(a) up to 16 members nominated by ethnocultural groups and organizations in accordance with a procedure established by the minister; and
(b) up to five members selected by the minister.
4(2) The term of a member is three years, and no member may serve more than two successive terms.
4(3) The members of the council shall elect a chairperson and vice-chairperson from among the members of the council.
4(4) The council is to meet at least
(a) six times each year; and
(b) once with the minister every six months.
4(5) Fourteen members of the council constitute a quorum.
4(6) Each member of the council shall be paid such reasonable expenses as may be approved by the minister.
5 The minister may refer to the council a matter relating to the purposes of the council. The council shall consider the matter and submit to the minister a written report of its findings or recommendations.
6 The council may refer to the minister for consideration a matter relating to the carrying out of its purposes.
7(1) The council must submit to the minister quarterly reports of its affairs and activities.
7(2) The minister shall include in the annual report of his or her department a review of the quarterly reports submitted by the council.
8 This Act may be referred to as chapter E148 of the Continuing Consolidation of the Statutes of Manitoba.
9 This Act comes into force on the day it receives royal assent.
