HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART 1

GENERAL

THE APPRENTICESHIP AND CERTIFICATION ACT

C.C.S.M. c. A110 amended

1           Subsection 4(4) of the English version of The Apprenticeship and Certification Act is amended by striking out "chair" and substituting "chairperson".

THE BLIND AND DEAF PERSON'S MAINTENANCE AND EDUCATION ACT

C.C.S.M. c. B60 repealed

2            The Blind and Deaf Person's Maintenance and Education Act, R.S.M. 1987, c. B60, is repealed.

THE CANCERCARE MANITOBA ACT

C.C.S.M. c. C20 amended

3(1)        The CancerCare Manitoba Act is amended by this section.

3(2)        Subsection 7.1(5) of the French version is amended

(a) in the section heading, by striking out "rapport" and substituting "projet"; and

(b) by striking out "et lui présente de nouveau le rapport" and substituting "et le lui présente de nouveau".

6            Clause 84(1)(c) of the English version of The Consumer Protection Act is amended by striking out "under The The" and substituting "under The".

THE COOPERATIVES ACT

C.C.S.M. c. C223 amended

7(1)         The Cooperatives Act is amended by this section.

7(2)        Subsection 75(6) of the French version is amended by striking out "réputée avoir reçu" and substituting "réputée avoir reçue".

7(3)        Subsection 338(1) of the French version is amended

(a) in the section heading, by striking out "Répartitions" and substituting "Répartition"; and

THE COOPERATIVE PROMOTION TRUST ACT

C.C.S.M. c. C224 amended

8(1)        The Cooperative Promotion Trust Act is amended by this section.

8(2)        Subsection 2(3) is amended

(a) by striking out "through which the Cooperatives Act is administered" and substituting "over which the minister presides"; and

(b) in the French version, by striking out "toutefois," and substituting ". Toutefois,".

8(3)        Subsections 2(3) and 7(1) of the English version are amended by striking out "Lieutenant-Governor-in-Council" and substituting "Lieutenant Governor in Council".

THE CORPORATIONS ACT

C.C.S.M. c. C225 amended

9(1)        The Corporations Act is amended by this section.

9(2)        Subsection 182(3) is amended by striking out "Parts XXI, XXII, XXIII, and XXIV apply" and substituting "Part XXI, XXII, XXIII or XXIV applies".

9(3)        Subsection 270(1) of the English version is amended by striking out "Incorporee" and substituting "Incorporée".

THE PROVINCIAL COURT ACT

C.C.S.M. c. C275 amended

10(1)       The Provincial Court Act is amended by this section.

10(2)       Subsection 6(1) is replaced with the following:

Resignation, retirement or appointment to other court

6(1)        A judge who resigns, retires or is appointed to another court after starting to hear a matter remains seized of the matter for a period of 12 weeks after the effective date of the resignation, retirement or appointment.

10(3)       Subsection 6(2) is amended

(a) in clause (c), by striking out "or impose sentence" and substituting ", impose sentence or do anything else"; and

(b) in the part after clause (c), by striking out "or retired" and substituting ", retired or been appointed to another court".

10(4)       Clause 6(3)(b) is amended by striking out "or retires" and substituting ", retires or is appointed to another court,".

THE COURT OF QUEEN'S BENCH ACT

C.C.S.M. c. C280 amended

11(1)        The Court of Queen's Bench Act is amended by this section.

11(2)       The following is added after subsection 11.17(2):

Judicial compensation report to masters

11.17(3)    Masters are entitled to receive the report of a Judicial Compensation Committee appointed under subsection 11.1(2) of The Provincial Court Act at the same time as the judges of the Provincial Court receive it.  Subsection 11.1(20) of that Act, respecting the confidentiality of the report, applies to the masters.

11(3)       Section 35 of the English version is amended by striking out "penalities" and substituting "penalties".

11(4)       Clause 39(1)(a) of the English version is amended by striking out "additonal" and substituting "additional".

THE CROWN LANDS ACT

C.C.S.M. c. C340 amended

12          Subsection 5(5) of The Crown Lands Act is repealed.

THE DRIVERS AND VEHICLES ACT

C.C.S.M. c. D104 amended

13(1)        The Drivers and Vehicles Act is amended by this section.

13(2)       Subsections 116.1(1) and (2) of the French version are amended in the section heading by striking out "Saisi" and substituting "Saisie".

13(3)       Subsection 126(7) of the French version is amended in the section heading by striking out "service" and substituting "services".

THE EDUCATION ADMINISTRATION ACT

C.C.S.M. c. E10 amended

14           Clause 4(1)(r.3) of the English version of The Education Administration Act is amended by striking out "to provided" and substituting "to provide".

THE ELECTIONS ACT

15          Subsection 49.1(2) of The Elections Act is amended in the part before clause (a) by striking out "and section 51.1".

16(1)       The Elections Finances Act is amended by this section.

16(2)       Clause 60(c) of the French version is amended by striking out "contestée" and substituting "disputée".

16(3)       Subsection 69(3) of the French version is amended in the part before clause (a) by striking out "à l'orateur" and substituting "au président".

16(4)       Section 88 is amended in the part before clause (a) by adding "or (1.1)" after "subsection 56(1)".

17(1)       The Environment Act is amended by this section.

17(2)       Clauses 11(8)(a) and 12(4)(a) are amended by striking out "central public registry" and substituting "public registry".

17(3)       Subsections 11(12) and (13) and subsection 12(8) are amended by striking out "central registry" and substituting "public registry".

THE FAMILY PROPERTY ACT

C.C.S.M. c. F25 amended

18          The definition "asset" in subsection 1(1) of The Family Property Act is amended by striking out "marital home" and substituting "family home".

THE FATALITY INQUIRIES ACT

C.C.S.M. c. F52 amended

19          Subsection 34(4) of The Fatality Inquiries Act is replaced with the following:

Judge unable to complete inquest

34(4)       If the judge presiding over an inquest

(a) resigns, retires or is appointed to another court, and is unable to complete the inquest and the required report within the period during which he or she remains seized of the matter under subsection 6(1) of The Provincial Court Act; or

(b) is unable for any other reason to complete the inquest and the required report;

the minister shall direct another provincial judge to complete the matter or to conduct a new inquest.

THE FIRES PREVENTION AND EMERGENCY RESPONSE ACT

C.C.S.M. c. F80 amended

20          Subsection 43(3) of the French version of The Fires Prevention and Emergency Response Act is amended by striking out "l'envoi se fait" and substituting "le lendemain tombe".

THE FUNERAL DIRECTORS AND EMBALMERS ACT

C.C.S.M. c. F195 amended

21(1)       The Funeral Directors and Embalmers Act is amended by this section.

21(2)       The definition "board" in section 1 is amended by striking out "Board of Administration" and substituting "Funeral Board of Manitoba".

21(3)       Subsections 2(1) and 7(2) are amended by striking out "Board of Administration" and substituting "Funeral Board of Manitoba".

21(4)       The section heading to subsection 15(2) is amended by striking out "Licence for premises from which funerals are conducted" and substituting "Registration".

THE PREARRANGED FUNERAL SERVICES ACT

C.C.S.M. c. F200 amended

22           The Prearranged Funeral Services Act is amended by adding the following after subsection 10(2):

Limitation period

10(3)       A prosecution for an offence under this Act may be commenced not more than one year after the day on which evidence sufficient to justify a prosecution for the offence came to the knowledge of the board.

THE GAMING CONTROL ACT

C.C.S.M. c. G5 amended

23(1)       The Gaming Control Act is amended by this section.

23(2)       Section 9.1 of the French version is amended by striking out "adopte et applique" and substituting "adoptent et appliquent".

23(3)       Subsection 9.2(1) of the French version is amended by striking out "soumet à la Commission une ébauche de sa politique" and substituting "soumettent à la Commission une ébauche de leur politique".

23(4)       Section 9.4 of the French version is amended by striking out "met à la disposition du public sa politique" and substituting "mettent à la disposition du public leur politique".

23(5)       Subsection 10(2) of the French version is amended by striking out "désire conduire et administrer une loterie au Manitoba obtient" and substituting "désirent conduire et administrer une loterie au Manitoba obtiennent".

THE GARAGE KEEPERS ACT

24(1)       The Garage Keepers Act is amended by this section.

24(2)       Section 6 is amended by striking out "an action of replevin has been commenced under subsection 7(2)" and substituting "the garage keeper brings a motion for an interim order for the recovery of personal property referred to in subsection 7(2)".

24(3)       Subsection 7(2) is amended

(a) in the section heading, by striking out "Replevin action" and substituting "Court proceedings"; and

(b) by striking out "bring an action of replevin under The Replevin Act" and substituting "commence an action and bring a motion under section 59 of The Court of Queen's Bench Act for an interim order for the recovery of personal property".

THE HOTEL KEEPERS ACT

25           Subsection 6(3) of the English version of The Hotel Keepers Act is amended by striking out "ofthe" and substituting "of the".

THE INCOME TAX ACT

26(1)       The Income Tax Act is amended by this section.

26(2)       Clause 11.5(2)(d) of the French version is amended by striking out "d'un fond" and substituting "d'un fonds".

26(3)       Subsection 28.1(2) of the French version is amended by adding "ou" before "est sur le point".

THE JURY ACT

27           Clause 3(g) of The Jury Act is amended by striking out "or of the Department of the Solicitor-General" and substituting ", the Public Prosecution Service or the Department of Public Safety and Emergency Preparedness".

THE DEPARTMENT OF JUSTICE ACT

C.C.S.M. c. J35 amended

28           Subsection 4(2) of the English version of The Department of Justice Act is amended by adding "the" before "order".

THE LABOUR MOBILITY ACT

C.C.S.M. c. L5 amended

29          The definition "occupational standard" in section 2 of the English version of The Labour Mobility Act is amended by striking out "regulatory authority" and substituting "regulatory body".

THE LAW REFORM COMMISSION ACT

C.C.S.M. c. L95 amended

30          The section heading to section 1 of the English version of The Law Reform Commission Act is amended by striking out "Definition" and substituting "Definitions".

THE LEGISLATIVE ASSEMBLY ACT

C.C.S.M. c. L110 amended

31(1)        The Legislative Assembly Act is amended by this section.

31(2)        Clause 17(1)(f) of the French version is amended by adding "du Manitoba" after "d'aide juridique".

31(3)        Subsection 30(1) of the French version is amended by striking out "tant que à l'Assemblée" and substituting "tant que l'Assemblée".

31(4)       Clause 52.3.1(b) of the English version is amended by striking out "her" and substituting "he".

31(5)       Clause 52.6.1(1)(a) is amended in the part before subclause (i) by adding "for the period consisting of all fiscal years that ended" before "during".

31(6)       Subsection 52.23(3.2) is amended by striking out "by the Legislative Assembly Management Commission".

31(7)       Section 52.29 is replaced with the

Members' Allowances Office

52.29       The office commonly known as the "Members' Allowances Office" is responsible for administering, under the supervision of the Clerk of the Assembly, the regulations respecting members' allowances.

31(8)       Clause (d) of the French version of the definition "rémunération supplémentaire" in subsection 69(1) is amended by striking out "vice-président" wherever it occurs and substituting "président adjoint".

Transitional

31(9)       Despite the wording of subsection 52.6.1(1), the first report of the manager of the Members' Allowances Office under that provision after the coming into force of this section is for the period between the date regulations made by the allowances commissioner to implement the decisions made in his report under subsection 52.7.1(3) come into effect and March 31, 2011.

THE LEGISLATIVE ASSEMBLY MANAGEMENT COMMISSION ACT

C.C.S.M. c. L114 amended

32           Clause 6(b) of The Legislative Assembly Management Commission Act is amended

(a) by adding "the registrar appointed under The Lobbyists Registration Act," after "Auditor General,";

(b) by adding "the Information and Privacy Adjudicator appointed under The Freedom of Information and Protection of Privacy Act," after "the Chief Electoral Officer,"; and

(c) by adding ", the Conflict of Interest Commissioner appointed under The Legislative Assembly and Executive Council Conflict of Interest Act," after "the Children's Advocate".

THE LEGISLATIVE LIBRARY ACT

C.C.S.M. c. L120 amended

33          The definition "officer of the Legislative Assembly" in section 1 of The Legislative Library Act is amended

(a) by adding "the Information and Privacy Adjudicator appointed under The Freedom of Information and Protection of Privacy Act," after "the Chief Electoral Officer,"; and

(b) by adding "the registrar appointed under The Lobbyists Registration Act," after "Auditor General,".

THE LIFE LEASES ACT

C.C.S.M. c. L130 amended

34          Section 34 of The Life Leases Act is amended by renumbering it as subsection 34(1) and adding the following as subsection 34(2):

Exception for property managers

34(2)       Nothing in subsection (1) prevents a non-profit corporation from acting as the property manager for more than one residential complex.

THE LIMITATION OF ACTIONS ACT

C.C.S.M. c. L150 amended

35          The Schedule to The Limitation of Actions Act is amended as follows:

(a) by replacing item 5 with the following:

(b) in section 17, by striking out "Section 172" and substituting "Section 189";

(c) in section 19, by striking out "The Testators Family Maintenance Act" and substituting "The Dependants Relief Act"; and

(d) in section 21, by striking out "Subsections 41(8)" and substituting "Subsections 41(7) or (8)".

THE MARRIED WOMEN'S PROPERTY ACT

36          Subsection 7(1) of the French version of The Married Women's Property Act is amended by striking out "détenues" and substituting "détenus".

THE MIDWIFERY ACT

C.C.S.M. c. M125 amended

37(1)        The Midwifery Act is amended by this section.

37(2)       Clause 2(2)(b) of the French version is amended by striking out "les drogues indiquées" and substituting "les médicaments indiqués".

37(3)       Clause 50(1)(c) of the French version is amended by striking out "les drogues" and substituting "les médicaments".

THE MINING CLAIM TAX ACT

43          The section heading of subsection 16.1(1) of the French version of The Ombudsman Act is amended by striking out "du protecteurs" and substituting "du protecteur".

THE OPTOMETRY AMENDMENT ACT

S.M. 2008, c. 13 (unproclaimed provisions) amended

44(1)       The Optometry Amendment Act, S.M. 2008, c. 13, is amended by this section.

44(2)       The following is added after subsection 10(2):

10(2.1)     Section 1 is further amended by adding the following definition:

"optometrist" means a person licensed or certified to practise optometry in a province or territory in Canada; (« optométriste »)

44(3)       Subsections 10(4) and (5) are replaced with the following:

10(4)       Subsection 63(2) is amended by adding "optometrist," before "dentist" wherever it occurs.

10(5)       Clause 74(b) is amended by adding "optometrist," before "dentist" wherever it occurs.

THE PENSION BENEFITS ACT

45           Subsection 33(1) of the French version of The Pension Benefits Act is amended by striking out "dissolution" wherever it occurs and substituting "liquidation".

THE PERSONAL HEALTH INFORMATION ACT

46          Subsection 14(2) of The Personal Health Information Act is amended by adding the following after clause (c):

(c.1) the information may be disclosed to the trustee under subsection 22(2); or

47          Clause 29(b) of the English version of The Personal Health Information Amendment Act (2), S.M. 2008, c. 41, is replaced with the following:

"midwife" means a person licensed or certified to practise midwifery in a province or territory in Canada; (« sage-femme »)

"registered nurse" means a person licensed or certified to practise registered nursing in a province or territory in Canada; (« infirmière »)

49(3)       Clause 2(2)(g) is amended by striking out "(extended practice)".

49(4)       Subsection 63(2) is amended by adding ", registered nurse, midwife" after "dentist" wherever it occurs.

49(5)       Clause 74(b) is amended by adding ", registered nurse, midwife" after "dentist" wherever it occurs.

THE PODIATRISTS ACT

S.M. 2001, c. 36 (unproclaimed provisions) amended

50(1)       The Podiatrists Act, as enacted by S.M. 2001, c. 36, is amended by this section.

50(2)       Subsection 67(3) is replaced with the following:

67(3)       Subsection 2(2) is amended by adding the following after clause (h):

(i) prevents a podiatrist from prescribing or administering a drug if he or she is permitted to do so under The Podiatrists Act.

PART 3

COMING INTO FORCE

Coming into force

90(1)       This Act, except sections 15, 33, 47, 55, 64 and 66, subsections 16(4) and 31(6) and clauses 32(a) and (b), comes into force on the day it receives royal assent.

90(2)       Sections 15, 47 and 66 and subsection 31(6) are deemed to have come into force on October 9, 2008.

90(3)       Subsection 16(4) is deemed to have come into force on June 13, 2006.

90(4)       Clauses 32(a) and 33(b) and section 55 come into force on the same day that The Lobbyists Registration Act, S.M. 2008, c. 43, Sch. A., comes into force.

90(5)       Clauses 32(b) and 33(a) come into force on the same day that section 23 of The Freedom of Information and Protection of Privacy Amendment Act, S.M. 2008, c. 40, comes into force.
