THE STATUTES CORRECTION AND MINOR AMENDMENTS ACT, 2008

(Assented to October 9, 2008)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE ADOPTION ACT

C.C.S.M. c. A2 amended

1(1)        The Adoption Act is amended by this section.

1(2)        Subsection 1(1) of the French version is amended in clause (b) of the definition "agence extraprovinciale" by striking out "toute autre organisation ou fonctionnaire du gouvernement" and substituting "tout autre organisation ou fonctionnaire d'un gouvernement".

1(3)        Clause 19(b) of the French version is amended by striking out "aient été faits" and substituting "ont été faits".

1(4)        Subsection 26(4) of the French version is amended

(a) in the part before clause (a), by striking out "que";

(b) in clause (a), by adding "que" before "l'intérêt"; and

(c) in clause (b),

(i) by striking out "il est impossible" and substituting "qu'il est impossible", and

(ii) by striking out "aient été accomplis" and substituting "ont été accomplis".

1(5)        Subsection 30(1) of the French version is amended

1(8)        Clause 75(c) of the English version is amended by striking out "neither husband and wife" and substituting "not married to each other".

1(9)        Subsection 100(2) of the French version is amended

(a) in clause (b), by striking out "de la justice;" and substituting "de la justice."; and

(b) in the part after clause (b), by striking out "dans ce cas" and substituting "Dans ce cas".

1(10)       Clause 104(1)(c) of the French version is amended in the part before subclause (i) by adding "conclu" after "un accord".

1(11)       Subsection 113(2) of the French version is amended by striking out "refus de communication" and substituting "refus de prise de contact".

THE AGROLOGISTS ACT

C.C.S.M. c. A50 amended

2           Subsection 12(8) of The Agrologists Act is amended by striking out ", under the seal of the court or under the hand of the convicting magistrate or justice of the peace, or under the hand of the clerk of the magistrate's court," and substituting "from the convicting court".

THE APOLOGY ACT

S.M. 2007, c. 25 amended

3           The following is added after section 2 of The Apology Act:

2.1         This Act may be referred to as chapter A98 of the Continuing Consolidation of the Statutes of Manitoba.

THE ARBITRATION ACT

C.C.S.M. c. A120 amended

4           Subsection 57(2) of The Arbitration Act is amended by striking out "section 60" and substituting "section 59".

THE BUILDERS' LIENS ACT

C.C.S.M. c. B91 amended

5           Section 62 of The Builders' Liens Act is amended by striking out "the plaintiff may sign interlocutory judgment against the defendant" and substituting "the defendant may be noted in default and the plaintiff may proceed to trial in accordance with this Act".

THE CHARITIES ENDORSEMENT ACT

C.C.S.M. c. C60 amended

6           Clause 2(3)(c) of the English version of The Charities Endorsement Act is amended by striking out "husband, wife" and substituting "spouse".

THE CHIROPRACTIC ACT

C.C.S.M. c. C100 amended

7           Section 44 of The Chiropractic Act is amended by striking out ", under the seal of the court, or under the hand of the convicting provincial judge, magistate or justice of the peace, or under the hand of the clerk of the court or provincial court or magistrate's court, as the case may be," and substituting "from the convicting court".

LE COLLÈGE UNIVERSITAIRE DE SAINT-BONIFACE ACT

C.C.S.M. c. C150.2 amended

8           Section 1 of Le Collège universitaire de Saint-Boniface Act is amended by striking out "section 6.1" and substituting "section 2.1".

THE COMMODITY FUTURES ACT

C.C.S.M. c. C152 amended

9           The definition "associate" in subsection 1(1) of The Commodity Futures Act is amended

(a) in subclause (d)(i), by adding ", common-law partner" after "a spouse";

(b) in subclause (d)(ii), by adding "or common-law partner" after "her spouse"; and

(c) by replacing everything after subclause (d)(ii) with the following:

and for this purpose, "common-law partner" of a particular individual means another individual, who not being married to the particular individual, is cohabiting with him or her in a conjugal relationship of some permanence;

THE CONSUMER PROTECTION ACT

C.C.S.M. c. C200 amended

10(1)       The Consumer Protection Act is amended by this section.

10(2)       Subsection 45(3) is amended by striking out "this section" and substituting "subsections (1) and (2)".

10(3)       Clause 78(1)(c) is repealed.

THE CONSUMER PROTECTION AMENDMENT ACT (COST OF CREDIT DISCLOSURE AND MISCELLANEOUS AMENDMENTS)

S.M. 2005, c. 16 amended

11(1)       The Consumer Protection Amendment Act (Cost of Credit Disclosure and Miscellaneous Amendments), S.M. 2005, c. 16, is amended by this section.

11(2)       Subsection 3(3) of the French version is replaced with the following:

3(3)        Les définitions de « acheteur » et de « vendeur », figurant au paragraphe 1(1), sont modifiées par substitution, à « S'entend », de « Sauf à la partie XV, s'entend ».

THE CONSUMER PROTECTION AMENDMENT ACT (GOVERNMENT CHEQUE CASHING FEES)

S.M. 2006, c. 17 amended

12          Section 3 of The Consumer Protection Amendment Act (Government Cheque Cashing Fees), S.M. 2006, c. 17, is repealed.

THE CONVENTION CENTRE CORPORATION ACT

S.M. 1988-89, c. 39 amended

13          Subsection 13(2) of the English version of The Convention Centre Corporation Act is amended by striking out "of the corporation of the corporation" and substituting "of the corporation".

THE CORPORATIONS ACT

C.C.S.M. c. C225 amended

14(1)       The Corporations Act is amended by this section.

14(2)       Clause 234(2)(a) of the English version is amended by striking out "act of omission" and substituting "act or omission".

14(3)       Subsection 267(2) is amended in the part after clause (d) by striking out "Minister of Intergovernmental Affairs and Trade" and substituting "Minister of Intergovernmental Affairs".

14(4)       The definition "extra-provincial loan corporation" in section 315 is replaced with the following:

"extra-provincial loan corporation" means

(a) an extra-provincial corporation incorporated in Canada, in any province other than Manitoba or in any territory of Canada that is a loan corporation in its jurisdiction of incorporation, and

(b) a cooperative credit association that is incorporated under the Cooperative Credit Associations Act (Canada) and is a retail association, as defined in that Act; (« corporation de prêt extra-provinciale »)

14(5)       The part of subsection 343(1) after clause (b) and the definition ""entered" or "entry"" in subsection 344(1) are amended by striking out "44" and substituting "46".

THE PROVINCIAL COURT ACT

15           Clause 47(b) of The Provincial Court Act is amended by striking out "The Domestic Violence and Stalking Prevention, Protection and Compensation Act" and substituting "The Domestic Violence and Stalking Act".

THE COURT OF QUEEN'S BENCH ACT

16(1)       The Court of Queen's Bench Act is amended by this section.

16(2)       Section 1 is amended

(a) in the definition "chief justice" in the English version, by striking out "Queen's Bench" and substituting "Court of Queen's Bench";

(b) in the definition "judge" in the English version, by striking out "Queen's Bench" wherever it occurs and substituting "Court of Queen's Bench"; and

(c) in the definition "rules", by striking out "Queen's Bench Rules" and substituting "rules".

16(3)       Subsection 5(1) of the English version is amended by striking out "Queen's Bench" wherever it occurs and substituting "Court of Queen's Bench".

16(4)       Subsection 5(3) is amended

THE COURT OF QUEEN'S BENCH SMALL CLAIMS PRACTICES ACT

C.C.S.M. c. C285 amended

17(1)       The Court of Queen's Bench Small Claims Practices Act is amended by this section.

17(2)        Clause 9(1)(b) is amended by striking out everything after "adjourn the claim".

17(3)       Subsection 12(4) is amended

(a) by striking out "signing" and substituting "filing"; and

(b) by striking out "immediately" and substituting  ", in accordance with the rules of the court,".

THE CROWN ATTORNEYS ACT

C.C.S.M. c. C330 amended

18(1)       The Crown Attorneys Act is amended by this section.

18(2)       Section 4 is amended by striking out "or" at the end of clause (b) and repealing clause (c).

18(3)       Clause 5(1)(b) is amended by striking out "magistrate or justice of the peace" and substituting "justice".

THE CROWN CORPORATIONS PUBLIC REVIEW AND ACCOUNTABILITY ACT

C.C.S.M. c. C336 amended

19          The Crown Corporations Public Review and Accountability Act is amended in the Schedule by striking out "Venture Manitoba Tours Ltd.".

THE CHILD CUSTODY ENFORCEMENT ACT

C.C.S.M. c. C360 amended

20(1)       The Child Custody Enforcement Act is amended by this section.

20(2)       Subsection 14(1) of the English version is amended by striking out "resistence" and substituting "resistance".

20(3)        Article 13 of the English version of the Schedule is amended by striking out "physcial" and substituting "physical".

THE DENTAL ASSOCIATION ACT

C.C.S.M. c. D30 amended

21(1)        The Dental Association Act is amended by this section.

21(2)       The definition "certificate of registration" in section 1 is amended by striking out "subsection 15.1(2)" and substituting "subsection 15.2(2)".

21(3)        Clauses 9(1)(j.1) and 10(1)(c) are amended by striking out "section 15.1" and substituting "section 15.2".

21(4)        The section 15.1 that is located immediately before section 16 is renumbered as section 15.2.

THE DEPENDANTS RELIEF ACT

C.C.S.M. c. D37 amended

22           The definition "spouse" in section 1 of The Dependants Relief Act is amended in the part before clause (a) by striking out "either of a man or woman" and substituting "either of two persons".

THE DOMESTIC VIOLENCE AND STALKING ACT

C.C.S.M. c. D93 amended

23(1)       The Domestic Violence and Stalking Act is amended by this section.

23(2)       Clause 14(1)(d) is amended by striking out "section 13" and substituting "clause 10(1)(b.2) or subsection 10(5)".

23(3)       Subsection 14(2) is amended by striking out "section 13 (occupancy of family residence)" and substituting "subsection 10(6) (right of occupancy restricted)".

THE DRIVERS AND VEHICLES ACT

C.C.S.M. c. D104 amended

24(1)       The Drivers and Vehicles Act is amended by this section.

24(2)       Subsection 1(1) is amended in clause (b) of the definition "driver's licence" by striking out "279(3)" and substituting "279(23)".

24(3)       Subsection 41(3) is amended by striking out "this section" and substituting "section 40".

24(4)       Subsection 114(2) of the English version is amended in the part after clause (b) by striking out "peace office" and substituting "peace officer".

24(5)        Clause 142(1)(a) is amended by striking out "have it for inspected" and substituting "have it inspected".

THE DRIVERS AND VEHICLES ACT AND THE HIGHWAY TRAFFIC AMENDMENT ACT

S.M. 2005, c. 37, amended

25(1)        The Drivers and Vehicles Act and The Highway Traffic Amendment Act, S.M. 2005, c. 37, is amended by this section.

25(2)       Schedule B is amended by replacing subclause 75(1)(g)(i) of the English version with the following:

(i) by striking out "respecting the fees" and substituting "specifying the charges", and

THE DUTCH ELM DISEASE ACT

C.C.S.M. c. D107 amended

26          Clause (a) of the definition "municipality" in section 1 of The Dutch Elm Disease Act is amended by striking out "The Municipal Act" and substituting "The Interpretation Act".

THE DYKING AUTHORITY ACT

27(1)        The Dyking Authority Act is amended by this section.

27(2)       Section 1 is amended by adding the following definition:

"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)

27(3)       Section 9 is amended by striking out "staff of the Water Branch, who may be the Director of Water" and substituting "department".

27(4)        Clause 10(b) is amended by striking out "Minister of Intergovernmental Affairs and Trade" and substituting "Minister of Intergovernmental Affairs".

THE ELECTIONS REFORM ACT

S.M. 2006, c. 15 amended

28(1)       The Elections Reform Act, S.M. 2006, c. 15, is amended by this section.

28(2)       Subsection 48(6) of Schedule B is replaced with the following:

48(6)       Subsection 55.8(1) is amended by striking out "an election period" and substituting "a campaign period".

THE ELECTORAL DIVISIONS ACT

29           Subsection 8(8) of The Electoral Divisions Act is amended by striking out "section 9" and substituting "section 10".

THE EMERGENCY MEDICAL RESPONSE AND STRETCHER TRANSPORTATION ACT

30(1)       The Emergency Medical Response and Stretcher Transportation Act is amended by this section.

30(2)        The definition "board" in section 1 is amended by adding "Appeal" after "Manitoba Health".

Communication during marriage

8           No married person is compellable to disclose any communication made to that person by his or her spouse during their marriage.

40          The following is added after section 31 of The Fisheries Act:

Minister may delegate

31.1        The minister may delegate to an employee of the government any duty or power conferred or imposed on the minister under this Act or the regulations, except the power to make regulations.

41(1)       The Gas Pipe Line Act is amended by this section.

41(2)       Subsection 26(5) is amended

(a) in the part before clause (a) of the French version, by striking out "La droit" and substituting "Le droit"; and

THE GROUND WATER AND WATER WELL ACT

42(1)       The Ground Water and Water Well Act is amended by this section.

42(2)       Section 1 is amended

(a) by replacing the definition "department" with the following:

"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)

(b) by repealing the definition "director".

42(3)       Subsection 4(1) is amended by striking out "director" and substituting "department".

42(4)       Subsection 4(2) is amended by striking out "The director, or any officer of the department authorized by him" and substituting "An officer of the department authorized by the minister".

42(5)       Clause 6(a) is amended by striking out "the director" and substituting "an officer of the department".

42(6)       Section 7 is replaced with the following:

Access to wells and records

7           An officer of the department authorized by the minister has access to all wells, and to all records, plants and equipment relating to or used in, or in connection with, wells and the drilling of wells.  Every well driller and owner must permit such an officer to enter upon the premises at all reasonable times, inspect any wells, operations, records, plants or equipment there, and take samples or carry out tests or examinations that the officer considers necessary.

42(7)       Subsection 10(3) is amended

(a) in the part before clause (a), by striking out "the director" and substituting "an officer of the department authorized by the minister"; and

(b) in the part after clause (b), by striking out "the director" wherever it occurs and substituting "the officer".

42(8)        Clause 12(g) of the French version is amended by striking out "par les cadres de la Direction" and substituting "par les fonctionnaires du ministère".

THE HEALTH AND POST SECONDARY EDUCATION TAX LEVY ACT

43          The definition "local government body" in section 1 of the English version of The Health and Post Secondary Education Tax Levy Act is amended by adding "or" at the end of clause (d).

44          Subsection 6(2) of the English version of The Manitoba Health Research Council Act is amended by striking out "insure" and substituting "ensure".

(a) by striking out "magistrate" and substituting "court"; and

(a) in a contract or by a declaration, designate his or her personal representative or a beneficiary as a person to whom or for whose benefit insurance money payable under the contract is to be paid; and

(b) by a declaration, change or revoke the designation from time to time.

50(3)       Subsection 225(3) is replaced with the following:

Right to sue

225(3)      A beneficiary designated under section 224 may enforce for his or her own benefit, and a trustee appointed under section 226 may enforce as trustee, the payment of insurance money payable under the contract to the beneficiary or for his or her benefit.

Insurer's defences

225(4)      In an action by the beneficiary or trustee, the insurer may set up any defence that it could have set up against the insured or his or her personal representative.

Payment discharges insurer

225(5)      Payment by the insurer to the beneficiary or trustee discharges the insurer to the extent of the amount paid.

90           Sections 3 and 8 of The Unconditional Grants Act are amended by striking out "Minister of Intergovernmental Affairs and Trade" wherever it occurs and substituting "Minister of Intergovernmental Affairs".

THE UNIVERSITY OF MANITOBA ACT

C.C.S.M. c. U60 amended

91           The University of Manitoba Act is amended

(a) in subsection 22(1), by striking out "Minister of Advanced Education and Training" and substituting "Minister of Advanced Education and Literacy"; and

(b) in clauses 26(1)(q) and 37(c), by striking out "Deputy Minister of Advanced Education and Training" and substituting "Deputy Minister of Advanced Education and Literacy".

THE VITAL STATISTICS ACT

C.C.S.M. c. V60 amended

92(1)       The Vital Statistics Act is amended by this section.

92(2)       Clause 3(6)(a) is amended by striking out "husband" and substituting "spouse" wherever it occurs.

92(3)       Section 39 is replaced with the following:

Annual report

39          The director must prepare a statistical report of the births, stillbirths, marriages, common-law relationships, deaths, adoptions and changes of name for the previous calendar year and include it in the annual report required by subsection 24(1) of The Special Operating Agencies Financing Authority Act.

THE WATER POWER ACT

C.C.S.M. c. W60 amended

93(1)       The Water Power Act is amended by this section.

93(2)       Section 1 is amended

(a) by repealing the definition "director"; and

(b) by adding the following definition:

"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)

93(3)       The centred heading before section 2 is replaced with "ADMINISTRATION OF THE ACT".

93(4)       In the following provisions, "Water Branch" is struck out wherever it occurs and "department" is substituted:

(a) sections 2 and 3;

(b) subsection 12(2).

93(5)       Section 7 of the English version is amended in the part after clause (d) by striking out "pusposes" and substituting "purposes".

93(6)       Section 13 and its section heading are amended by striking out "director" and substituting "department".

93(7)       Subsection 14(3) of the English version is amended in the section heading by striking out "director and".

THE WATER PROTECTION ACT

S.M. 2005, c. 26 amended

94          Section 44 of The Water Protection Act S.M. 2005, c. 26, is repealed.

THE WATER RESOURCES ADMINISTRATION ACT

C.C.S.M. c. W70 amended

95(1)       The Water Resources Administration Act is amended by this section.

95(2)       Section 1 is amended by repealing the definition "branch".

95(3)       Subsections 2(1) and (2) are repealed.

95(4)       Subsection 2(3) is amended

(a) in the part before clause (a), by striking out "through the branch and";

(b) by repealing clause (c); and

(c) by replacing clause (f) with the following:

(f) The Water Supply Commissions Act.

95(5)       Subsection 2(4) is amended

(a) in the French version in the part before clause (a), by striking out "Lorsqu'en vertu d'une loi visée au paragraphe (3) ou d'une prérogative royale" and substituting "Lorsqu'en vertu d'une loi visée au paragraphe (3), de toute autre loi de l'Assemblée législative ou d'une prérogative royale,";

(b) by replacing everything after clause (b) of the English version with the following:

(c) under an agreement made with the Government of Canada;

the minister is responsible for constructing or operating

(d) any such water control works that the government is required to construct or operate; and

(e) on being duly authorized for the purpose, any such water control works that the government is authorized to construct or operate;

and the direction and control thereof shall be carried out by the minister.

(c) by replacing everything after clause (e) of the French version with the following:

95(6)       Section 2.1 is amended by renumbering it as subsection 2.1(1) and adding the following as subsection 2.1(2):

Restricting access to floodway

2.1(2)      Without limiting the generality of subsection (1) and despite anything contained in this Act, the Manitoba Floodway Authority

(a) has the power and authority to deny or restrict access to the floodway to any person other than an employee or officer of the government who requires access to the floodway in the course of his or her duties; and

(b) may require a person to obtain approval from it before undertaking any activity on the floodway or on Crown land near the floodway, and may impose conditions on an approval given to a person.

95(7)        Clause 7(f) is amended by striking out "Minister of Intergovernmental Affairs and Trade" and substituting "Minister of Intergovernmental Affairs".

95(8)       Section 8 is amended in the part before clause (a) by striking out ", through the branch,".

95(9)       Section 15 is amended by striking out everything after "the minister".

95(10)      Subsection 25(1) is amended in the part after clause (e) by striking out "in the branch".

THE MANITOBA WATER SERVICES BOARD ACT

C.C.S.M. c. W90 amended

96(1)       The Manitoba Water Services Board Act is amended by this section.

96(2)       Section 1 is amended by adding the following definition:

THE WILDLIFE ACT

C.C.S.M. c. W130 amended

97(1)        The Wildlife Act is amended by this section.

97(2)       Section 1 is amended

(a) by repealing the definition "non-resident alien"; and

(b) by adding the following definition:

"foreign resident" means a person who is not a resident or a Canadian citizen; (« résident étranger »)

97(3)       Section 20 is amended

(a) by replacing the section heading with "Prohibitions re protected species"; and

(b) by striking out "listed in Division 6 of Schedule A" and substituting "that is listed or designated as a protected species under this Act or the regulations".

97(4)       Subsection 69.1(1) is amended by adding "The Endangered Species Act," after "this Act,".

97(5)       Subclause 90(a)(ii) and clause 90(m) are amended by striking out "non-resident aliens" and substituting "foreign residents".

97(6)       The English version of Division 2 of Schedule A is amended by striking out "Artic Fox" and substituting "Arctic Fox".

THE WILD RICE ACT

C.C.S.M. c. W140 amended

98          The following is added after section 30 of The Wild Rice Act:

Delegation by minister

30.1        The minister may delegate to an employee of the government any power conferred or duty imposed on the minister under this Act or the regulations, except the power to make regulations.

THE CITY OF WINNIPEG CHARTER

S.M. 2002, c. 39 amended

99(1)       The City of Winnipeg Charter, S.M. 2002, c. 39, is amended by this section.

99(2)       Clause 23(2)(b) is amended by striking out ", magistrate".

99(3)       Subsection 217(1) is amended by adding "grants in lieu of taxes," after "personal property taxes,".

99(4)       Section 511 is replaced with the following:

Exemption by L.G. in C.

511         If the Lieutenant Governor in Council considers it in the public interest and advisable for the purpose of carrying out or participating in a program or project, the Lieutenant Governor in Council may, by regulation, order that a by-law, resolution, decision or procedure passed, made or required under this Act does not apply to and is not binding on an agency or person, including a statutory corporation or institution, named in the regulation for purposes set out in the regulation.

THE WORKERS COMPENSATION ACT

C.C.S.M. c. W200 amended

100(1)      The Workers Compensation Act is amended by this section.

100(2)      Sections 71 and 71.2 of the English version are amended by striking out "assembly" wherever it occurs, including in the section headings, and substituting "Assembly".

100(3)      Subsection 81.1(2) of the French version is amended in the part before clause (a), by adding "de" after "quasi-totalité".

100(4)      Clause 104(3)(b) is amended by striking out "10 days" and substituting "15 days".

COMING INTO FORCE

Coming into force

101(1)       This Act, except sections 25, 28, 56, 75 and 79, subsections 11(2) to (6) and subsections 50(2) and (3), comes into force on the day it receives royal assent.

101(2)      Subsections 11(3) and (4) come into force on the same day that subsection 3(5) and clause 3(6)(c) of The Consumer Protection Amendment Act (Cost of Credit Disclosure and Miscellaneous Amendments, S.M. 2005, c. 16, come into force.

101(3)      Subsections 11(2), (5) and (6) are deemed to have come into force on April 1, 2007.

101(4)      Section 25 is deemed to have come into force on June 16, 2005.

101(5)      Section 28 comes into force on the same day that section 48 of Schedule B of The Elections Reform Act, S.M., 2006, c. 15, comes into force.

101(6)      Subsections 50(2) and (3) come into force on the same day that section 20 of The Insurance Amendment Act S.M., 2007, c. 10, comes into force.

101(7)      Section 56 is deemed to have come into force on August 10, 2005.

101(8)      Section 75 comes into force on the same day that section 22 of The Pension Benefits Amendment Act, S.M. 2005, c. 2, comes into force.
