The Child and Family Services Amendment Act (Child Protection Penalties)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Child and Family Services Act is amended by this Act.

Section 18.3 is amended

(a) in the English version, by replacing the section heading with "Offences";

(b) in the English version of clause (d), by striking out "harrasses" and substituting "harasses"; and

(c) by replacing the part after clause (d) with the following:

the person is guilty of an offence and is liable on summary conviction to a fine of not more than $50,000. or imprisonment for a term of not more than 24 months, or both.

Subsection 20(7) is replaced with the following:

Offence

20(7)

Any person who violates the provisions of an order made under this section is guilty of an offence and is liable on summary conviction to a fine of not more than $50,000. or imprisonment for a term of not more than 24 months, or both.

Subsection 38(6) is amended by striking out "punishable on summary conviction" and substituting "and is liable on summary conviction to a fine of not more than $50,000. or imprisonment for a term of not more than 24 months, or both".

The part of section 52 after clause (e) is replaced with the following:

The part of section 84 after clause (b) is replaced with the following:

is guilty of an offence and is liable on summary conviction to a fine of not more than $50,000. or imprisonment for a term of not more than 24 months, or both.

Coming into force

This Act comes into force on the day it receives royal assent.
