THE STATUTES CORRECTION AND MINOR AMENDMENTS ACT, 2001
(Assented to July 6, 2001)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
PART 1
GENERAL
THE CIVIL SERVICE SUPERANNUATION ACT
1 Subsection 26(1.3) of the French version of The Civil Service Superannuation Act is amended by striking out "0,006" and substituting ".006".
THE COLLEGES ACT
2 Section 10 of the English version of The Colleges Act is amended by adding "Governor" after "Lieutenant".
THE COOPERATIVES ACT
3 Subsection 269(7) of the English version of The Cooperatives Act is amended by striking out "that the" and substituting "the".
THE CORPORATION CAPITAL TAX ACT
4 Subclause 8(2)(g)(ii) of The Corporation Capital Tax Act is replaced with the following:
(ii) the lien note represents financing by way of a security interest in itemized new or used motor vehicle inventory or on itemized new or used farm machinery and equipment inventory.
THE COURT OF QUEEN'S BENCH ACT
5 The definition "family proceeding" in section 41 of The Court of Queen's Bench Act is amended
(a) in clause (b), by striking out "guardianship of infants" and substituting "guardianship of the person of an infant"; and
(b) by repealing clause (i).
THE DYKING AUTHORITY ACT
6(1) The Dyking Authority Act is amended by this section.
6(2) Section 9 is amended
(a) by striking out "The Water Resources Branch" and substituting "the Water Branch"; and
(b) by striking out "Director of Water Resources" and substituting "Director of Water".
THE ELECTIONS ACT
7(1) The Elections Act is amended by this section.
7(2) Clause 11(1)(e) of the French version is amended by striking out "cinq àans" and substituting "cinq ans".
7(3) Section 65 is amended
(a) in subsection (4), by striking out "Monday" and substituting "second Monday"; and
(b) in subsection (5) of the English version, by striking out "Chief Electoral officer" and substituting "Chief Electoral Officer".
7(4) Subsection 102(1) is amended in the part before clause (a) by adding ", cause to be delivered," after "shall deliver".
7(5) Clause 124(5)(b) is amended by striking out "person" and substituting "voter".
7(6) Section 162 is amended by striking out "voters list," wherever it occurs.
7(7) Subsection 174.1(2) of the English version is amended by adding "Officer" before "may appoint".
7(8) Clause 175(b) of the English version is amended by striking out "deputy returning officer" and substituting "deputy returning officers".
THE ELECTIONS FINANCES ACT
8 Subsection 41(1.1) of the French version of The Elections Finances Act is amended by adding "aux particuliers" after "interdit".
THE EMPLOYMENT AND INCOME ASSISTANCE ACT
9 The definition "director" in section 1 of The Employment and Income Assistance Act is amended by striking out "the Executive Director for whom provision is made" and substituting "a Director of Field Services, Employment and Income Assistance, as provided".
THE FARM MACHINERY AND EQUIPMENT ACT
10 Clause 62(1)(o) of the French version of The Farm Machinery and Equipment Act is amended by renumbering the second subclause "(iv)" as subclause "(vi)".
THE GROUND WATER AND WATER WELL ACT
11 The definitions "department" and "director" in section 1 of The Ground Water and Water Well Act are amended by striking out "The Water Resources Branch" and substituting "the Water Branch".
THE HELEN BETTY OSBORNE MEMORIAL FOUNDATION ACT
12 Section 3 of The Helen Betty Osborne Memorial Foundation Act is amended by adding "for all purposes" after "foundation is".
THE INSURANCE ACT
13 Subsection 5(1) of the French version of The Insurance Act is amended by striking out "assureur" and substituting "assureurs".
THE JUDGMENTS ACT
14(1) The Judgments Act is amended by this section.
14(2) Subsection 11(2) is amended
(a) in the section heading, by striking out "sec. 34" and substituting "section 33"; and
(b) in the subsection, by striking out "Section 34" and substituting "Section 33".
THE LAW ENFORCEMENT REVIEW ACT
15 Subsection 24(3) of The Law Enforcement Review Act is amended by adding "and protections" after "powers".

16 Subsection 81(2) of the French version of The Legislative Assembly Act is amended by striking out "celle" and substituting "la pension".
THE MARRIAGE ACT
17 Subsection 18(1) of the French version of The Marriage Act is amended in the part before clause (a) by striking out "informé" and substituting "informée".

18 The centred heading before section 38 of The Medical Act is amended by adding "AND PROGRAM REVIEW COMMITTEE" after "STANDARDS COMMITTEE".
THE MOTIVE FUEL TAX ACT
19 Subsection 11(15) of the French version of The Motive Fuel Tax Act is amended
(a) by striking out "garde ses livres et ses registres" and substituting "gardent leurs livres et leurs registres"; and
(b) by striking out "prend" and substituting "prennent".
THE MUSEUMS AND MISCELLANEOUS GRANTS ACT
20 The title of the French version of The Museums and Miscellaneous Grants Act is amended by adding "LES MUSÉES ET" after "LOI SUR".
THE PERSONAL PROPERTY SECURITY AND CONSEQUENTIAL AMENDMENTS ACT
21 The Personal Property Security and Consequential Amendments Act, S.M. 1993, c. 14, is amended by repealing section 75, subsections 76(3) and (4), and section 80.
THE PUBLIC HEALTH ACT
22 Clause 28(l) of the English version of The Public Health Act is amended by adding "be" after "circumstances to".
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
23 Subsection 20(5) of the English version of The Manitoba Public Insurance Corporation Act is amended by striking out "general manager" and substituting "chief executive officer".
THE PUBLIC SCHOOLS ACT
24 Subsection 263(1) of The Public Schools Act is amended by striking out "The Employment Standards Act" and substituting "The Employment Standards Code".
THE SOCIAL SERVICES ADMINISTRATION ACT
25(1) The Social Services Administration Act is amended by this section.
25(2) Subsection 2(1) is amended
(a) by replacing the section heading with "Director of Field Services, Employment and Income Assistance"; and
(b) by striking out "an Director of Income Assistance" and substituting "one or more persons designated as Directors of Field Services, Employment and Income Assistance,".
25(3) Subsection 2(2) is amended
(a) by striking out "The Director of Income Assistance may" and substituting "A Director of Field Services, Employment and Income Assistance, may"; and
(b) in the English version, by striking out "upon the Director of Income Assistance".
THE VULNERABLE PERSONS LIVING WITH A MENTAL DISABILITY ACT
26 Clause 44(1)(b) of the French version of The Vulnerable Persons Living with a Mental Disability Act is amended in the part before subclause (i) by striking out "au sujet" and substituting "auprès".
THE WATER POWER ACT
27(1) The Water Power Act is amended by this section.
27(2) In the following provisions, "The Water Resources Branch" is struck out and "the Water Branch" is substituted:
(a) in the definition "director" in section 1;
(b) in sections 2 and 3;
27(3) The centred heading before section 2 is replaced with "WATER BRANCH".
THE WATER RESOURCES ADMINISTRATION ACT
28(1) The Water Resources Administration Act is amended by this section.
28(2) The definition "branch" in section 1 is amended by striking out "The Water Resources Branch" and substituting "the Water Branch".
28(3) Subsection 2(1) is replaced with the following:
2(1) The Water Resources Branch is continued as the Water Branch.
THE WATER RESOURCES CONSERVATION AND PROTECTION ACT
29 Section 9 of the French version of The Water Resources Conservation and Protection Act is amended by striking out "W75" and substituting "W72".
THE WATER RIGHTS ACT
30(1) The Water Rights Act is amended by this section.
30(2) Section 10 of the French version is amended by striking out "l'eau l'eau" and substituting "l'eau".
30(3) Clause 17(1)(c) of the French version is amended by striking out "une brèche ces ouvrages" and substituting "une brèche".
30(4) Subsection 17(2) of the French version is amended by adding "ou d'ouvrages de régularisation des eaux" after "à l'égard d'ouvrages".

31(1) The Workers Compensation Act is amended by this section.
31(2) Subsection 29(7) of the French version is amended by striking out "monis" and substituting "moins".
31(3) Clause 39(1)(a) of the French version is amended by striking out "un minimum" and substituting "une période maximale".
31(4) Subsection 39(3) of the French version is amended by striking out "d'asssurance-salaire" and substituting "d'assurance-salaire".
31(5) Clause 40(5)(a) of the French version is amended by striking out "net".

32(1) The Amusements Act is amended by this section.
32(2) Clauses 7(1)(a) and 9(1)(b) are amended by striking out "Minister of Labour" and substituting "Minister of Labour and Immigration".
32(3) Subsection 7(2) is amended by striking out "Department of Labour" and substituting "Department of Labour and Immigration".

33 Clause 33(2)(a) of The Architects Act is amended by striking out "Minister of Labour" and substituting "Minister of Labour and Immigration".

36 Clause 45(2)(d) of The Registered Dietitians Act is replaced with the following:
(d) one person nominated by the Minister of Advanced Education; and

37 Clause 11(1)(a) of The Education Administration Act is replaced with the following:
(a) the deputy minister or a designate of the deputy minister;

38(1) The Electricians' Licence Act is amended by this section.
38(2) Section 1 is amended by replacing the definitions "department" and "minister" with the following:
"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
38(3) Subsection 10(3) is amended
(a) in the English version of the section heading, by striking out "Department of Labour Act" and substituting "Department of Labour and Immigration Act"; and
(b) in the subsection, by striking out "The Department of Labour Act" and substituting "The Department of Labour and Immigration Act".

39 Section 1 of The Elevator Act is amended by replacing the definitions "department" and "minister" with the following:

40 Section 1 of The Employment Services Act is amended by replacing the definition "minister" with the following:

THE EMPLOYMENT STANDARDS CODE
41(1) The Employment Standards Code is amended by this section.
41(2) The definition "department" in subsection 1(1) is replaced with the following:
"department" means the department of government over which the minister presides and through which this Code is administered; (« ministère »)
41(3) The definition "employment standards officer" in subsection 1(1) is amended by striking out "The Department of Labour Act" and substituting "The Department of Labour and Immigration Act".
41(4) Section 120 is amended by striking out "The Department of Labour Act" and substituting "The Department of Labour and Immigration Act".
THE ENGINEERING AND GEOSCIENTIFIC PROFESSIONS ACT
42 Clauses 8(2)(d), 67(2)(a) and 68(2)(a) of The Engineering and Geoscientific Professions Act are amended by striking out "Minister of Labour" and substituting "Minister of Labour and Immigration".
THE GAS AND OIL BURNER ACT
43 The definition "minister" in section 1 of The Gas and Oil Burner Act is replaced with the following:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)
THE HIGHWAY TRAFFIC ACT
44(1) The Highway Traffic Act is amended by this section.
44(2) In the following provisions, "Minister of Highways" is struck out and "minister" is substituted:
(a) subsections 71(1) and 77(8);
(b) section 81;
(c) clause 82(1)(c);
(d) subsection 90(9), in the section heading and in the subsection;
(e) subsection 104(3);
44(3) Subsection 104(2) is amended
(a) by striking out "Minister of Highways" and substituting "minister"; and

45(3) The definition "department" in section 1 is amended by striking out "The Department of Labour" and substituting "the Department of Labour and Immigration".
45(4) Section 2 is amended
(a) in the section heading, by striking out "Department of Labour" and substituting "Department of Labour and Immigration";
(b) in the section, by striking out "Government of Manitoba called: "The Department of Labour"" and substituting "government called the "Department of Labour and Immigration""; and
(c) by striking out "Minister of Labour" and substituting "Minister of Labour and Immigration".
45(5) Section 4 of the English version is amended in the section heading and in the section by striking out "vice-chairman" and substituting "vice-chairperson".

47 Sections 2, 3 and 4 of An Act Respecting Debts Owing by Municipalities to School Districts are amended by striking out "Minister of Education and Training" and substituting "Minister of Education, Training and Youth".

48 Clause 49(2)(b) of The Occupational Therapists Act is amended by striking out "Minister of Education and Training" and substituting "Minister of Advanced Education".
THE OFF-ROAD VEHICLES ACT
49 Clause (a) of the definition "traffic authority" in subsection 1(1) of The Off-Road Vehicles Act is amended by striking out "Minister of Highways and Government Services" and substituting "minister".

61(1) The Remembrance Day Act is amended by this section.
61(2) Section 1 is amended by adding the following definition in alphabetical order:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
61(3) Section 5 is amended
(a) by striking out "Minister of Labour" and substituting "minister"; and
(b) in the English version, by striking out "he" and substituting "he or she".
THE STEAM AND PRESSURE PLANTS ACT
62(1) The Steam and Pressure Plants Act is amended by this section.
62(2) Section 1 is amended
(a) by adding the following definition in alphabetical order:
"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)
(b) by replacing the definition "minister" with the following:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
62(3) In the following provisions, "The Department of Labour" is struck out and "the department" is substituted:
(a) subsection 7(3);
(b) section 14;
(c) clause 18(f).
THE TEACHERS' SOCIETY ACT
63 The definitions "department" and "minister" in section 1 of The Teachers' Society Act are replaced with the following:
"department" means the Department of Education, Training and Youth; (« ministère »)
"minister" means the Minister of Education, Training and Youth; (« ministre »)
THE TRANS-CANADA HIGHWAY ACT
64 Section 1 of The Trans-Canada Highway Act is amended in the part before clause (a) by striking out "Minister of Highways" and substituting "Minister of Transportation and Government Services".
THE UNIVERSITY OF MANITOBA ACT
65(1) The University of Manitoba Act is amended by this section.
65(2) Subsection 22(1) is amended by striking out "Minister of Education and Training" and substituting "Minister of Advanced Education".
65(3) Clause 26(1)(q) is replaced with the following:
(q) the Deputy Minister of Advanced Education, or his or her designate.
65(4) Clause 37(c) is replaced with the following:
(c) the Deputy Minister of Advanced Education, or his or her designate;
PART 3
COMING INTO FORCE
66(1) This Act, except sections 12 and 21, comes into force on the day it receives royal assent.
66(2) Section 12 is retroactive and is deemed to have come into force on December 15, 2000.
66(3) Section 21 is retroactive and is deemed to have come into force on September 4, 2000.
