THE MANITOBA EVIDENCE AMENDMENT ACT
(Assented to June 28, 1997)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
The Manitoba Evidence Act is amended by this Act.
The following is added after section 10:
DISCLOSURE OF INFORMATION
Definition of "legal proceeding"
In this section, "legal proceeding" means an action or proceeding in the Provincial Court of Manitoba for the imposition of punishment by fine, penalty, or imprisonment to enforce an Act of the Legislature or to enforce a regulation made under an Act of the Legislature.
Appeal from an order for the disclosure of information
In any legal proceeding, an appeal lies at the instance of the Attorney General of Manitoba to the Court of Queen's Bench from an order for the disclosure of information.
An order for the disclosure of information referred to in subsection (2) includes
(a) an order for the disclosure or production of documents; and
(b) an order for the preparation of an inventory of documents.
An appeal under subsection (2) must be brought within 10 days after the date of the order appealed from, or within such further time as the Court of Queen's Bench considers appropriate in the circumstances.
An appeal lies to the Court of Appeal from an order of the Court of Queen's Bench under this section.
An appeal under subsection (5) must be brought within 10 days after the date of the order appealed from or within such further time as the Court of Appeal considers appropriate in the circumstances.
Date of appeal may be expedited
When an appeal is brought under subsection (2) or (5), the Court of Queen's Bench or the Court of Appeal, as the case may be, may order that the date of the appeal be expedited.
This Act comes into force on the day it receives royal assent.
