THE NATURAL PRODUCTS MARKETING AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Natural Products Marketing Act is amended by this Act.

2(1)

Section 29 is amended by adding the following after clause (i):

(i.1) authorizing any producer board or marketing commission to conduct a pool for the distribution of all money received under an agreement described in section 46.1, from the sale of a regulated product or otherwise, and requiring the producer board or marketing commission, after deducting all necessary and proper disbursements and expenses, after making such allowances for reserves as may be approved by the Manitoba council, and after making any deductions authorized by the agreement, to distribute the remainder of the money in the pool in such a manner that every producer receives a share of the money relative to the quantity, quality, variety, grade, class, or size of the regulated product delivered by him or her under the agreement, and authorizing the producer board or marketing commission to make an initial payment on delivery of the regulated product and subsequent payments until all the remainder of the money in the pool has been distributed to the producers;

Subclause 29(n)(i) is amended by adding  ", alone or together with any producer board, marketing commission or extra-provincial board," after "to conduct".

The following is added after section 46:

Agreement for co-ordinated marketing

46.1(1)

A producer board or marketing commission may make agreements for the co-ordinated marketing of a regulated product with one or more of the Government of Canada, the government of a province, an agency of the Government of Canada or of the government of a province, and an extra-provincial board.

Terms of agreement

46.1(2)

An agreement under subsection (1) may provide for the pooling of revenue and may authorize a producer board or marketing commission to exercise on behalf of the Government of Canada or any of its agencies any power relating to inter-provincial or export marketing of a regulated product that a producer board or a marketing commission may exercise in relation to intra-provincial marketing of the regulated product.

Pooling agreement

46.1(3)

A producer board or marketing commission authorized to conduct a pool under this Act pursuant to an agreement under subsection (1) may conduct the pool in co-operation with a party to the agreement, and money received under such an agreement shall be added to the pool and money paid out under such an agreement shall be deducted from the pool.

Coming into force

This Act comes into force on the day it receives royal assent.
