THE TOURISM AND RECREATION AMENDMENT ACT


 

(Assented to November 19, 1996)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Tourism and Recreation Act is amended by this Act.

Section 1 is amended

(a) by repealing the definition "transient accommodation facilities"; and

(b) by adding the following definition in alphabetical order:

"lodge" means a hunting lodge, fishing lodge or out-camp where the public may, for consideration, obtain sleeping accommodation; (« pavillon »)

Section 3 of the English version is amended in the part following clause (b) by striking out "him" and substituting "him or her".

The heading "TRANSIENT ACCOMMODATION FACILITIES" preceding section 5 is repealed.

Subsection 5(1) is amended

(a) by striking out "any transient accommodation facilities unless he" and substituting "a lodge unless he or she"; and

(b) in the English version by striking out "him" and substituting "him or her".

5(2)

Subsection 5(2) is amended by striking out "transient accommodation facilities unless he" and substituting "a lodge unless he or she".

Section 7 is repealed and the following is substituted:

Classification of lodges

7(1)

The minister may classify lodges according to the standards established in the regulations, and may issue to the operator of a lodge a sign that sets out its classification.

Display of sign

7(2)

The operator shall display the sign issued by the minister as required by the regulations.

Subsection 8(1) is amended

(a) in clauses (a) and (b), by striking out "transient accommodation facilities" and substituting "lodges";

(b) by adding the following after clause (b):

(b.1) respecting the display of a sign setting out the classification of a lodge;

(c) in clauses (c) and (e), by striking out "transient accommodation facilities" and substituting "lodges".

7(2)

Subsection 8(2) is amended by striking out "transient accommodation facilities" and substituting "lodges".

The heading "GENERAL" preceding section 10 is repealed.

Coming into force

This Act comes into force on the day it receives royal assent.
