THE ANIMAL HUSBANDRY ACT

1           Section 85 of the French version of The Animal Husbandry Act is repealed and the following is substituted:

(b) in clause (c), by striking out "and unionized" and substituting "or unionized".

THE HIGHWAY TRAFFIC ACT

11(1)       The Highway Traffic Act is amended by this section.

11(2)       In the following provisions, "The Highways Department Act" is struck out and "The Highways and Transportation Department Act" is substituted:

(a) subsection 1(1), in the definitions "industrial road" and "provincial highway"; and

(b) subsection 297(1).

11(3)       Subsection 24(7) of the French version is amended by striking out "un période" and substituting "une période".

11(4)       Subsection 28(1.2) of the French version is amended by striking out "bénéficent" and substituting "bénéficient".

11(5)       Subsection 35(15.1) of the French version is amended

(a) in that part preceding clause (a), by striking out "garder allumer" and substituting "garder allumé"; and

(b) in clause (a), by adding a comma after "remorque".

11(6)       Clause 327(7.1)(a) of the French version is amended by striking out "du paragraphe" and substituting "de l'alinéa".

THE INSURANCE ACT

C.C.S.M. c. I40

12(1)       The Insurance Act is amended by this section.

12(2)       Clause 32(1)(a) is repealed and the following is substituted:

(a) in the case of an insurer undertaking life insurance (other than a mutual benefit society) and that was not licensed on March 17, 1943, a certified copy of an order made under section 53 of the Insurance Companies Act (Canada);

12(3)       Section 49 is repealed and the following is substituted:

Return of deposit to insurer with federal order

49          Where a licensed insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the Minister of Finance may return to the insurer its deposit.

12(4)       Section 50 is repealed and the following is substituted:

Payment out of deposit on reinsurance by insurer with federal order

50          Where a licensed insurer, hereinafter called the "continuing insurer", has acquired the assets and assumed the liabilities within the province of another licensed insurer, hereinafter called the "discontinuing insurer", or has reinsured all the contracts of a discontinuing insurer outstanding within the province, and where the continuing insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the Minister of Finance may, upon the application of the continuing insurer and the discontinuing insurer, pay out the deposit of the discontinuing insurer to the continuing insurer or to the discontinuing insurer.

12(5)       Subsection 76(1) is repealed and the following is substituted:

Investment of surplus funds

76(1)       An insurer, incorporated and licensed under the laws of the province, may invest its surplus funds and reserve in any investments in which an insurer who has obtained an order under section 53 of the Insurance Companies Act (Canada) is permitted under that Act to invest its funds.

12(6)       Subsection 88(8) is repealed and the following is substituted:

Insurer with federal order

88(8)       Where an insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the requirements of this section with reference to that insurer in respect of valuations, deductions and rates of interest may be modified or altered as may be necessary to permit the insurer to comply with the requirements of the Superintendent of Financial Institutions appointed pursuant to the Office of the Superintendent of Financial Institutions Act (Canada).

12(7)       Subsection 396.1(2) of the English version is amended by striking out "establishement" and substituting "establishment".

THE LEGAL AID SERVICES SOCIETY OF MANITOBA ACT

13(1)       The Legal Aid Services Society of Manitoba Act is amended by this section.

13(2)       Subsection 17.1(2) is repealed and the following is substituted:

Registration of statement in L.T.O.

17.1(2)     Where an applicant who owns or has an interest in land in Manitoba receives legal aid, the executive director may register in a Land Titles Office a statement certifying that the applicant has received legal aid and setting out the name of the applicant, the legal description of the land, and the society's address for service.

13(3)       Subsection 17.1(4) is repealed and the following is substituted:

Effect of registration

17.1(4)     From the time of its registration, a statement registered under subsection (2) binds and forms a lien and charge on the applicant's estate or interest in the land against which it is registered for an amount equal to the cost of the legal aid provided to the applicant, before and after the date of registration; but no such statement has the effect of severing a joint tenancy or affecting a right under The Dower Act.

17(2)       Section 1 is amended

26(2)       Subsection 1(1) is amended, in the definition "motor vehicle", by adding "or" at the end of clause (e) and by adding the following after clause (e):

(f) an off-road vehicle as defined in The Off-Road Vehicles Act.

26(3)       Subsection 2(1) is amended by striking out "eight" and substituting "nine".

THE PUBLIC SCHOOLS ACT

27(1)       The Public Schools Act is amended by this section.

27(2)       Subsection 7(6) of the French version is amended by striking out "la commission de révision" and substituting "la Commission de révision".

27(3)       Clause 60(5)(f), as enacted by S.M. 1989-90, c.49, s.12, is repealed.

27(4)       Subsection 60(5) is amended by adding the following as clause (f):

(f) the private school

(i) has received one or more grants under this subsection before the coming into force of this clause, or

(ii) commenced operating with pupils in attendance before the day this clause came into force and has been so operating for a period of at least two years following that day, and has been in compliance with clauses (a) to (e) and any requirements prescribed under clause (g) for each of those years, but has not received a grant under this subsection before that day, or

(iii) commenced operating with pupils in attendance on or after but not before the day this clause came into force and has been so operating for a period of at least three years, and has been in compliance with clauses (a) to (e) and any requirements prescribed under clause (g) for each of those years; and

27(5)       Subsection 179(1) of the French version is amended by striking out "après les avoir reçu" and substituting "après les avoir reçues".

29          Section 1 of The Public Works Act is amended, in the definition "public work",

THE REGULATIONS ACT

30(1)       The Regulations Act is amended by this section.

30(2)       The definition "regulation" in section 1 is repealed and the following is substituted:

"regulation" means

(a) a regulation, rule, order or by-law that

(i) is of a legislative nature and is made or approved in the execution of a power conferred by or under an Act of the Legislature, or

(ii) governs practice or procedure in quasi-judicial proceedings and is made or approved in the execution of a power conferred by a provision of an Act of the Legislature that uses the word "regulation" in conferring the power,

by

(iii) the Lieutenant Governor in Council, a group of ministers or a minister,

(iv) an individual, or

(v) a board, commission, association or other body, whether incorporated or unincorporated, all the members of which or all the members of the board of management or board of directors of which are appointed by an Act of the Legislature or by the Lieutenant Governor in Council, or

(b) a rule or regulation that governs practice or procedure in judicial proceedings and is made or approved in the execution of a power conferred by or under an Act of the Legislature,

but does not include

(c) a regulation, rule, order, by-law or resolution when made by a local authority,

(d) provisions that form part of a regulation, rule, order or by-law and that are adopted or incorporated by reference in the regulation, rule, order or by-law,

(e) a regulation, rule, order or by-law of The Municipal Board or The Public Utilities Board,

(f) a proclamation bringing into force or suspending an Act or a portion of an Act of the Legislature, or

(g) an order that is made in the execution of a power conferred by or under an Act of the Legislature and which confirms or disallows a regulation, rule, order or by-law. («règlement»)

30(3)       Section 19 is repealed.

THE WILDLIFE ACT

36(1)       The Wildlife Act is amended by this section.

36(2)       Section 1 is amended by repealing the definition "wildlife certificate".

36(3)       Section 30.1 is repealed and the following is substituted:

Trading in wild animals

30.1        Subject to this Act and the regulations, no person shall sell, buy, trade or barter, or attempt or offer to sell, buy, trade or barter, or keep for the purpose of sale, trade or barter, any wild animal or parts of a wild animal except under the authority of a licence or permit.

36(4)       Subsection 32(3) is amended by striking out ", polar bear".

36(5)        The following provisions are amended by striking out "licence, permit or wildlife certificate" wherever it occurs and substituting "licence or permit":

(a) subsections 55(1), (2) and (3);

(b) section 56;

(c) section 59;

VALIDATION

Public Schools Act re validation of 1986 mill rate differential in support levy

41(1)       Notwithstanding subsection 181(2) of The Public Schools Act, the number of mills differential allowed between education farm and residential assessment and other assessment for 1986, as set out in Order in Council 300/86, is 38 mills, and all decisions, actions and proceedings taken, all monies, levies or taxes paid or received, all penalties assessed or collected, and all rights or duties exercised with respect to that Order in Council, are hereby declared to be valid and binding on all persons affected by them.

41(2)       Notwithstanding subsection 181(2) of The Public Schools Act, the number of mills differential allowed between education farm and residential assessment and other assessment for 1987, as set out in Order in Council 163/87, is 43.7 mills, and all decisions, actions and proceedings taken, all monies, levies or taxes paid or received, all penalties assessed or collected, and all rights or duties exercised with respect to that Order in Council, are hereby declared to be valid and binding on all persons affected by them.

COMING INTO FORCE

Coming into force

42(1)       Subject to subsections (2) to (17), this Act comes into force on the day it receives royal assent.

Coming into force:  sections 1, 2, 6, 11(3) to (6), 20(2), 27(2),(5) and (6), 34 and 39

42(2)       Sections 1, 2 and 6, subsections 11(3) to (6), 20(2) and 27(2), (5) and (6) and sections 34 and 39 are retroactive and are deemed to have come into force on July 26, 1991.

Coming into force:  sections 4 and 15

42(3)       Sections 4 and 15 are retroactive and are deemed to have come into force on February 1, 1988.

Coming into force:  section 7

42(4)       Section 7 is retroactive and is deemed to have come into force on March 21, 1992.

Coming into force:  section 10

42(5)       Section 10 is retroactive and is deemed to have come into force on September 30, 1991.

Coming into force:  subsections 12(1) to (6)

42(6)       Subsections 12(1) to (6) are retroactive and are deemed to have come into force on June 1, 1992.

42(7)       Section 14 comes into force on the day that subsection 59(2.3) of The Legislative Assembly Act, as enacted by S.M. 1991-92, c.2, s.3, comes into force.

42(8)       Section 16 is retroactive and is deemed to have come into force on September 1, 1991.

Coming into force:  section 17

42(9)       Section 17 is retroactive and is deemed to have come into force on March 12, 1992.

Coming into force:  subsection 19(2)

42(10)      Subsection 19(2) comes into force on the day subsection 4(1) of The Mines and Minerals Act, as enacted by S.M. 1991-92, c.9, comes into force.

42(11)      Section 23 comes into force on July 1, 1992.

42(12)      Subsection 27(4) comes into force on a day fixed by proclamation.

42(13)      Section 30 is retroactive and is deemed to have come into force on December 20, 1988.
